1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the first day of instruction in certain school
1313 districts that provide additional days of instruction financed with
1414 local funds.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subsection (a), Section 25.0811, Education Code,
1717 is amended to read as follows:
1818 (a) Except as provided by this section, a [A] school
1919 district may not begin instruction for students for a school year
2020 before the fourth Monday in August. A school district may:
2121 (1) begin instruction for students for a school year
2222 before the fourth Monday in August if [unless] the district
2323 operates a year-round system under Section 25.084; or
2424 (2) begin instruction for students for a school year
2525 on or after the first Monday in August at a campus or at not more
2626 than 20 percent of the campuses in the district if:
2727 (A) the district has a student enrollment of
2828 150,000 or more;
2929 (B) the district at the beginning of the school
3030 year provides, financed with local funds, days of instruction for
3131 students at the campus or at each of the multiple campuses, in
3232 addition to the minimum number of days of instruction required
3333 under Section 25.081;
3434 (C) the campus or each of the multiple campuses
3535 are undergoing comprehensive reform, as determined by the board of
3636 trustees of the district; and
3737 (D) a majority of the students at the campus or at
3838 each of the multiple campuses are educationally disadvantaged.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2011.
