 A BILL TO BE ENTITLED
 AN ACT
 relating to the use of certain types of steel slag in road
 construction by the Texas Department of Transportation.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter B, Chapter 223, Transportation Code,
 is amended by adding Section 223.0451 to read as follows:
 Sec. 223.0451.  USE OF STEEL SLAG FOR ROAD CONSTRUCTION.
 Department design standards, guidelines, and specifications shall
 require that contract specifications for a road construction
 project allow for the use of electric arc furnace steel slag for
 paving, bridge construction, and other appropriate road
 construction unless that use is technically inappropriate
 according to sound engineering principles or increases the cost of
 that construction.
 SECTION 2.  This Act takes effect September 1, 2013.
