A BILL TO BE ENTITLED
AN ACT
relating to the adoption of rules by state agencies.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 2001, Government Code, is
amended by adding Section 2001.0205 to read as follows:
Sec. 2001.0205. ADOPTION OF RULES. A state agency may adopt
only rules that fulfill a purpose established by the constitutional
or statutory law governing the state agency and that are within the
state agency's authority to adopt.
SECTION 2. This Act takes effect September 1, 2013.
