88 AN ACT
99 relating to evaluating the performance, including computing
1010 dropout and completion rates, of public schools designated as
1111 dropout recovery schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 39, Education Code, is
1414 amended by adding Section 39.0545 to read as follows:
1515 Sec. 39.0545. EVALUATING DROPOUT RECOVERY SCHOOLS. (a)
1616 For purposes of evaluating performance under Section 39.053(c), the
1717 commissioner shall designate as a dropout recovery school a school
1818 district or an open-enrollment charter school or a campus of a
1919 district or of an open-enrollment charter school:
2020 (1) that serves students in grades 9 through 12 and has
2121 an enrollment of which at least 50 percent of the students are 17
2222 years of age or older as of September 1 of the school year as
2323 reported for the fall semester Public Education Information
2424 Management System (PEIMS) submission; and
2525 (2) that meets the eligibility requirements for and is
2626 registered under alternative education accountability procedures
2727 adopted by the commissioner.
2828 (b) Notwithstanding Section 39.053(c)(2), the commissioner
2929 shall use the alternative completion rate under this subsection to
3030 determine the student achievement indicator under Section
3131 39.053(c)(2) for a dropout recovery school. The alternative
3232 completion rate shall be the ratio of the total number of students
3333 who graduate, continue attending school into the next academic
3434 year, or receive a high school equivalency certificate to the total
3535 number of students in the longitudinal cohort of students.
3636 (c) Notwithstanding Section 39.053(c)(2), in determining
3737 the performance rating under Section 39.054 of a dropout recovery
3838 school, the commissioner shall include any student described by
3939 Section 39.053(g-1) who graduates or receives a high school
4040 equivalency certificate.
4141 (d) For a dropout recovery school, only the best result from
4242 the primary administration and any retake of an assessment
4343 instrument administered to a student in the school year evaluated
4444 under the accountability procedures adopted by the commissioner may
4545 be considered in determining the performance rating of the school
4646 under Section 39.054.
4747 SECTION 2. This Act applies beginning with the 2013-2014
4848 school year.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2013.
