|---|
| 10 | 10 | | dropout and completion rates, of public schools designated as |
|---|
| 11 | 11 | | dropout recovery schools. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter C, Chapter 39, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 39.0545 to read as follows: |
|---|
| 15 | 15 | | Sec. 39.0545. EVALUATING DROPOUT RECOVERY SCHOOLS. (a) |
|---|
| 16 | 16 | | For purposes of evaluating performance under Section 39.053(c), the |
|---|
| 17 | 17 | | commissioner shall designate as a dropout recovery school a school |
|---|
| 18 | 18 | | district or an open-enrollment charter school or a campus of a |
|---|
| 19 | 19 | | district or of an open-enrollment charter school: |
|---|
| 20 | 20 | | (1) that serves students in grades 9 through 12 and has |
|---|
| 21 | 21 | | an enrollment of which at least 50 percent of the students are 17 |
|---|
| 22 | 22 | | years of age or older as of September 1 of the school year as |
|---|
| 23 | 23 | | reported for the fall semester Public Education Information |
|---|
| 24 | 24 | | Management System (PEIMS) submission; and |
|---|
| 25 | 25 | | (2) that meets the eligibility requirements for and is |
|---|
| 26 | 26 | | registered under alternative education accountability procedures |
|---|
| 27 | 27 | | adopted by the commissioner. |
|---|
| 28 | 28 | | (b) Notwithstanding Section 39.053(c)(2), the commissioner |
|---|
| 29 | 29 | | shall use the alternative completion rate under this subsection to |
|---|
| 30 | 30 | | determine the student achievement indicator under Section |
|---|
| 31 | 31 | | 39.053(c)(2) for a dropout recovery school. The alternative |
|---|
| 32 | 32 | | completion rate shall be the ratio of the total number of students |
|---|
| 33 | 33 | | who graduate, continue attending school into the next academic |
|---|
| 34 | 34 | | year, or receive a high school equivalency certificate to the total |
|---|
| 35 | 35 | | number of students in the longitudinal cohort of students. |
|---|
| 36 | 36 | | (c) Notwithstanding Section 39.053(c)(2), in determining |
|---|
| 37 | 37 | | the performance rating under Section 39.054 of a dropout recovery |
|---|
| 38 | 38 | | school, the commissioner shall include any student described by |
|---|
| 39 | 39 | | Section 39.053(g-1) who graduates or receives a high school |
|---|
| 40 | 40 | | equivalency certificate. |
|---|
| 41 | 41 | | (d) For a dropout recovery school, only the best result from |
|---|
| 42 | 42 | | the primary administration and any retake of an assessment |
|---|
| 43 | 43 | | instrument administered to a student in the school year evaluated |
|---|
| 44 | 44 | | under the accountability procedures adopted by the commissioner may |
|---|
| 45 | 45 | | be considered in determining the performance rating of the school |
|---|
| 46 | 46 | | under Section 39.054. |
|---|
| 47 | 47 | | SECTION 2. This Act applies beginning with the 2013-2014 |
|---|
| 48 | 48 | | school year. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 53 | 53 | | Act takes effect September 1, 2013. |
