99 AN ACT
1010 relating to powers of the North Harris County Regional Water
1111 Authority relating to certain wells.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 4.03, Chapter 1029, Acts of the 76th
1414 Legislature, Regular Session, 1999, is amended by adding Subsection
1515 (e) to read as follows:
1616 (e) Notwithstanding any other law, the authority may impose
1717 a charge under Subsection (b) on a well or class of wells located
1818 within the boundaries of the authority that, on or after June 30,
1919 2013:
2020 (1) ceases to be subject to a groundwater reduction
2121 requirement imposed by the subsidence district; or
2222 (2) is no longer subject to the regulatory provisions,
2323 permitting requirements, or jurisdiction of the subsidence
2424 district.
2525 SECTION 2. The North Harris County Regional Water Authority
2626 retains all rights, powers, privileges, authorities, duties, and
2727 functions that it had before the effective date of this Act.
2828 SECTION 3. (a) The legislature validates and confirms all
2929 governmental acts and proceedings of the North Harris County
3030 Regional Water Authority that were taken before the effective date
3131 of this Act.
3232 (b) This section does not apply to any matter that on the
3333 effective date of this Act:
3434 (1) is involved in litigation if the litigation
3535 ultimately results in the matter being held invalid by a final court
3636 judgment; or
3737 (2) has been held invalid by a final court judgment.
3838 SECTION 4. (a) The legal notice of the intention to
3939 introduce this Act, setting forth the general substance of this
4040 Act, has been published as provided by law, and the notice and a
4141 copy of this Act have been furnished to all persons, agencies,
4242 officials, or entities to which they are required to be furnished
4343 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4444 Government Code.
4545 (b) The governor, one of the required recipients, has
4646 submitted the notice and Act to the Texas Commission on
4747 Environmental Quality.
4848 (c) The Texas Commission on Environmental Quality has filed
4949 its recommendations relating to this Act with the governor, the
5050 lieutenant governor, and the speaker of the house of
5151 representatives within the required time.
5252 (d) All requirements of the constitution and laws of this
5353 state and the rules and procedures of the legislature with respect
5454 to the notice, introduction, and passage of this Act are fulfilled
5555 and accomplished.
5656 SECTION 5. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2013.
