77 relating to standards for school district, public school campus,
88 and open-enrollment charter school performance ratings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 39.053, Education Code,
1111 is amended to read as follows:
1212 Sec. 39.053. PERFORMANCE INDICATORS: QUALITY OF LEARNING
1313 AND STUDENT ACHIEVEMENT.
1414 SECTION 2. Section 39.053, Education Code, is amended by
1515 adding Subsection (j) to read as follows:
1616 (j) Indicators of the quality of learning adopted under this
1717 section must include:
1818 (1) the percentage of teachers who teach a grade level
1919 or subject for which the teacher does not hold the appropriate
2020 certification;
2121 (2) the rates at which teachers are not retained; and
2222 (3) for each applicable grade level, the number of
2323 exceptions from the class size limits granted under Section 25.112.
2424 SECTION 3. Subsection (b), Section 39.054, Education Code,
2525 is amended to read as follows:
2626 (b) In evaluating performance, the commissioner shall
2727 evaluate against state standards and consider the performance of
2828 each campus in a school district and each open-enrollment charter
2929 school on the basis of the campus's or school's performance on the
3030 student achievement and quality of learning indicators adopted
3131 under Sections [Section] 39.053(c) and (j).
3232 SECTION 4. This Act applies beginning with the 2013-2014
3333 school year.
3434 SECTION 5. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2013.
