| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 39.053, Education Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 39.053. PERFORMANCE INDICATORS: QUALITY OF LEARNING |
|---|
| 13 | 13 | | AND STUDENT ACHIEVEMENT. |
|---|
| 14 | 14 | | SECTION 2. Section 39.053, Education Code, is amended by |
|---|
| 15 | 15 | | adding Subsection (j) to read as follows: |
|---|
| 16 | 16 | | (j) Indicators of the quality of learning adopted under this |
|---|
| 17 | 17 | | section must include: |
|---|
| 18 | 18 | | (1) the percentage of teachers who teach a grade level |
|---|
| 19 | 19 | | or subject for which the teacher does not hold the appropriate |
|---|
| 20 | 20 | | certification; |
|---|
| 21 | 21 | | (2) the rates at which teachers are not retained; and |
|---|
| 22 | 22 | | (3) for each applicable grade level, the number of |
|---|
| 23 | 23 | | exceptions from the class size limits granted under Section 25.112. |

| 24 | 24 | | SECTION 3. Subsection (b), Section 39.054, Education Code, |
|---|
| 25 | 25 | | is amended to read as follows: |
|---|
| 26 | 26 | | (b) In evaluating performance, the commissioner shall |
|---|
| 27 | 27 | | evaluate against state standards and consider the performance of |
|---|
| 28 | 28 | | each campus in a school district and each open-enrollment charter |
|---|
| 29 | 29 | | school on the basis of the campus's or school's performance on the |
|---|
| 30 | 30 | | student achievement and quality of learning indicators adopted |
|---|
| 31 | 31 | | under Sections [Section] 39.053(c) and (j). |
|---|
| 32 | 32 | | SECTION 4. This Act applies beginning with the 2013-2014 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2013. |
