12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 28.0216, Education Code, is amended to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | Sec. 28.0216. DISTRICT GRADING POLICY. (a) Before each |
---|
16 | 16 | | school year, a [A] school district shall adopt a grading policy, |
---|
17 | 17 | | including provisions for the assignment of grades on class |
---|
18 | 18 | | assignments and examinations and the calculation of cumulative |
---|
19 | 19 | | averages of grades[, before each school year]. A district grading |
---|
20 | 20 | | policy: |
---|
21 | 21 | | (1) must require a [classroom] teacher to assign a |
---|
22 | 22 | | grade that reflects the student's relative mastery of the subject |
---|
23 | 23 | | without employing grade inflation or misrepresenting a student's |
---|
24 | 24 | | deserved grade [an assignment]; |
---|
25 | 25 | | (2) may not require a [classroom] teacher to assign a |
---|
26 | 26 | | minimum grade [for an assignment] without regard to the student's |
---|
27 | 27 | | quality of work; and |
---|
28 | 28 | | (3) may allow a student a reasonable opportunity to |
---|
29 | 29 | | make up or redo a class assignment or examination for which the |
---|
30 | 30 | | student received a failing grade. |
---|
31 | 31 | | (b) A district grading policy shall apply to the assignment |
---|
32 | 32 | | of a grade for which written notice is required under Section |
---|
33 | 33 | | 28.022(a)(2), in addition to any other grade assigned by the |
---|
34 | 34 | | district. |
---|
35 | 35 | | SECTION 2. This Act applies beginning with the 2013-2014 |
---|
36 | 36 | | school year. |
---|
37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
---|
38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
---|
39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
---|
41 | 41 | | Act takes effect September 1, 2013. |
