99 AN ACT
1010 relating to the contents and applicability of a school district's
1111 grading policy.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 28.0216, Education Code, is amended to
1414 read as follows:
1515 Sec. 28.0216. DISTRICT GRADING POLICY. (a) Before each
1616 school year, a [A] school district shall adopt a grading policy,
1717 including provisions for the assignment of grades on class
1818 assignments and examinations and the calculation of cumulative
1919 averages of grades[, before each school year]. A district grading
2020 policy:
2121 (1) must require a [classroom] teacher to assign a
2222 grade that reflects the student's relative mastery of the subject
2323 without employing grade inflation or misrepresenting a student's
2424 deserved grade [an assignment];
2525 (2) may not require a [classroom] teacher to assign a
2626 minimum grade [for an assignment] without regard to the student's
2727 quality of work; and
2828 (3) may allow a student a reasonable opportunity to
2929 make up or redo a class assignment or examination for which the
3030 student received a failing grade.
3131 (b) A district grading policy shall apply to the assignment
3232 of a grade for which written notice is required under Section
3333 28.022(a)(2), in addition to any other grade assigned by the
3434 district.
3535 SECTION 2. This Act applies beginning with the 2013-2014
3636 school year.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2013.
