99 AN ACT
1010 relating to the cancer prevention and research fund.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subsections (b) and (c), Section 102.201, Health
1313 and Safety Code, are amended to read as follows:
1414 (b) The cancer prevention and research fund consists of:
1515 (1) patent, royalty, and license fees and other income
1616 received under a contract entered into as provided by Section
1717 102.255;
1818 (2) appropriations of money to the fund by the
1919 legislature, except that the appropriated money may not include the
2020 proceeds from the issuance of bonds authorized by Section 67,
2121 Article III, Texas Constitution;
2222 (3) gifts, grants, including grants from the federal
2323 government, and other donations received for the fund; and
2424 (4) interest earned on the investment of money in the
2525 fund.
2626 (c) The fund may be used only to pay for:
2727 (1) grants for cancer research and for cancer research
2828 facilities in this state to realize therapies, protocols, and
2929 medical procedures for the cure or substantial mitigation of all
3030 types of cancer in humans;
3131 (2) the purchase, subject to approval by the
3232 institute, of laboratory facilities by or on behalf of a state
3333 agency or grant recipient;
3434 (3) grants to public or private persons to implement
3535 the Texas Cancer Plan;
3636 (4) the operation of the institute; [and]
3737 (5) grants for cancer prevention and control programs
3838 in this state to mitigate the incidence of all types of cancer in
3939 humans; and
4040 (6) debt service on bonds issued as authorized by
4141 Section 67, Article III, Texas Constitution.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2013.
