1111 AN ACT
1212 relating to Temporary Assistance for Needy Families benefits
1313 accounts.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subsection (b), Section 31.0355, Human Resources
1616 Code, is amended to read as follows:
1717 (b) If a recipient of financial assistance who receives the
1818 assistance by electronic benefits transfer to an account is
1919 authorized to make a cash withdrawal from the account through a
2020 provider of the goods or services described by Subsection (a), the
2121 recipient may make the cash withdrawal only:
2222 (1) at the customer service department of the provider
2323 and not at the provider's point-of-sale terminal; and
2424 (2) after the provider verifies the recipient's
2525 identity in accordance with Section 31.0356, if applicable.
2626 SECTION 2. Subchapter B, Chapter 31, Human Resources Code,
2727 is amended by adding Sections 31.0356 and 31.0357 to read as
2828 follows:
2929 Sec. 31.0356. PHOTO IDENTIFICATION FOR CERTAIN CASH
3030 WITHDRAWALS. (a) In this section, "photo identification" means a
3131 card or other document that:
3232 (1) is issued by a governmental entity to identify an
3333 individual; and
3434 (2) displays a photograph of the individual identified
3535 on the card or other document.
3636 (b) A recipient of financial assistance who receives the
3737 assistance by electronic benefits transfer to an account may not,
3838 using an electronic benefits transfer card subject to Section
3939 31.0357(a), make a cash withdrawal from the account through a
4040 provider of the goods or services described by Section 31.0355(a)
4141 unless the recipient presents photo identification verifying the
4242 recipient's identity as the card holder. A provider may presume
4343 that an electronic benefits transfer card that does not display the
4444 name of a recipient and any other authorized person is not subject
4545 to Section 31.0357(a) for purposes of this section.
4646 Sec. 31.0357. NAMES ON ELECTRONIC BENEFITS TRANSFER CARDS.
4747 (a) Except as provided by Subsection (b), each electronic benefits
4848 transfer card issued to a recipient, or other person authorized on
4949 the recipient's account, for purposes of delivering benefits under
5050 the financial assistance program must display the name of the
5151 recipient and any other authorized person, if applicable.
5252 (b) An electronic benefits transfer card issued by a local
5353 commission eligibility office is not subject to Subsection (a).
5454 SECTION 3. Not later than December 1, 2013, the Health and
5555 Human Services Commission shall ensure that electronic benefits
5656 transfer cards issued for purposes of delivering benefits to
5757 recipients under the financial assistance program under Chapter 31,
5858 Human Resources Code, conform to Subsection (a), Section 31.0357,
5959 Human Resources Code, as added by this Act.
6060 SECTION 4. If before implementing any provision of this Act
6161 a state agency determines that a waiver or authorization from a
6262 federal agency is necessary for implementation of that provision,
6363 the agency affected by the provision shall request the waiver or
6464 authorization and may delay implementing that provision until the
6565 waiver or authorization is granted.
6666 SECTION 5. This Act takes effect September 1, 2013.
