| 11 | 11 | | state legislature to conduct a marriage ceremony. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 2.202, Family Code, is amended by |
|---|
| 14 | 14 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (a) The following persons are authorized to conduct a |
|---|
| 17 | 17 | | marriage ceremony: |
|---|
| 18 | 18 | | (1) a licensed or ordained Christian minister or |
|---|
| 19 | 19 | | priest; |
|---|
| 20 | 20 | | (2) a Jewish rabbi; |
|---|
| 21 | 21 | | (3) a person who is an officer of a religious |
|---|
| 22 | 22 | | organization and who is authorized by the organization to conduct a |
|---|
| 23 | 23 | | marriage ceremony; [and] |
|---|
| 24 | 24 | | (4) a justice of the supreme court, judge of the court |
|---|
| 25 | 25 | | of criminal appeals, justice of the courts of appeals, judge of the |
|---|
| 26 | 26 | | district, county, and probate courts, judge of the county courts at |
|---|
| 27 | 27 | | law, judge of the courts of domestic relations, judge of the |
|---|
| 28 | 28 | | juvenile courts, retired justice or judge of those courts, justice |
|---|
| 29 | 29 | | of the peace, retired justice of the peace, judge of a municipal |
|---|
| 30 | 30 | | court, or judge or magistrate of a federal court of this state; |
|---|
| 31 | 31 | | (5) a current member of the state legislature who has |
|---|
| 32 | 32 | | served as a member of the legislature for not less than 20 years; or |
|---|
| 33 | 33 | | (6) a former member of the state legislature who |
|---|
| 34 | 34 | | served as a member of the legislature for not less than 20 years. |

| 35 | 35 | | (a-1) A person authorized to conduct a marriage ceremony |
|---|
| 36 | 36 | | under Subsection (a)(5) or (6) may not conduct more than 12 marriage |
|---|
| 37 | 37 | | ceremonies in a 12-month period. |

| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2013. |
