1010 relating to access to birth records of certain adopted children.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 192.008, Health and Safety Code, is
1313 amended by adding Subsection (g) to read as follows:
1414 (g) If an adult adoptee who does not know the identity of one
1515 or both parents listed on the person's original birth certificate
1616 applies for access to the person's original birth certificate, the
1717 state registrar shall perform a search of reasonably available
1818 death records to determine if each parent named on the original
1919 birth certificate whose identity is unknown to the adoptee is
2020 deceased. Upon confirmation that each parent named on the original
2121 birth certificate whose identity is unknown to the adoptee is
2222 deceased, the registrar shall provide to the person a noncertified
2323 copy of the person's original birth certificate without a court
2424 order.
2525 SECTION 2. The change in law made by this Act applies to an
2626 application for an original birth certificate filed on or after the
2727 effective date of this Act, regardless of whether the suit for
2828 adoption was filed before, on, or after the effective date of this
2929 Act. An application for an original birth certificate filed before
3030 the effective date of this Act is governed by the law in effect on
3131 the date the application was filed, and the former law is continued
3232 in effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2013.
