99 AN ACT
1010 relating to unemployment compensation eligibility and chargebacks
1111 regarding certain persons who leave work to attend training.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subsection (e), Section 204.022, Labor Code, is
1414 amended to read as follows:
1515 (e) Benefits may not be charged to the account of an
1616 employer, regardless of whether the liability for the chargeback
1717 arises in the employee's current benefit year or in a subsequent
1818 benefit year, if the employee's last separation from the employer's
1919 employment before the employee's benefit year was or would have
2020 been excepted from disqualification under Section 207.023(b)(2) or
2121 207.045(j) [207.052(b)].
2222 SECTION 2. Section 207.045, Labor Code, is amended by
2323 adding Subsection (j) to read as follows:
2424 (j) An individual is not disqualified for benefits under
2525 this section if:
2626 (1) the individual left the individual's last work to
2727 attend commission-approved training under Section 207.022; and
2828 (2) the individual's last work did not constitute
2929 suitable work for the individual, as determined under Section
3030 207.008.
3131 SECTION 3. Section 207.052, Labor Code, is repealed.
3232 SECTION 4. The changes in law made by this Act apply only to
3333 a claim for unemployment compensation benefits filed with the Texas
3434 Workforce Commission on or after the effective date of this Act. A
3535 claim filed before the effective date of this Act is governed by the
3636 law in effect on the date the claim was filed, and the former law is
3737 continued in effect for that purpose.
3838 SECTION 5. This Act takes effect September 1, 2013.
