| 24 | 24 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 25 | 25 | | SECTION 1. Section 375.303, Local Government Code, is |
|---|
| 26 | 26 | | amended to read as follows: |
|---|
| 27 | 27 | | Sec. 375.303. DEFINITION [DEFINITIONS]. In this |
|---|
| 28 | 28 | | subchapter, "authority"[: |
|---|
| 29 | 29 | | [(1) "Authority"] means a defense adjustment |
|---|
| 30 | 30 | | management authority created under this subchapter. |
|---|
| 31 | 31 | | [(2) "Eligible project" means a program authorized by |
|---|
| 32 | 32 | | Section 379A.051 and a project as defined by Section 501.002 and |
|---|
| 33 | 33 | | Sections 505.151-505.156. Notwithstanding this definition, |
|---|
| 34 | 34 | | seeking a charter for or operating an open-enrollment charter |
|---|
| 35 | 35 | | school authorized by Subchapter D, Chapter 12, Education Code, |
|---|
| 36 | 36 | | shall not be an eligible project.] |
|---|
| 37 | 37 | | SECTION 2. Subchapter O, Chapter 375, Local Government |
|---|
| 38 | 38 | | Code, is amended by adding Section 375.3035 to read as follows: |
|---|
| 39 | 39 | | Sec. 375.3035. ELIGIBLE PROJECTS. (a) In this subchapter, |
|---|
| 40 | 40 | | eligible projects include only a: |
|---|
| 41 | 41 | | (1) program authorized by Section 379A.051; |
|---|
| 42 | 42 | | (2) project as defined by Section 501.002 and |
|---|
| 43 | 43 | | Sections 505.151-505.156; |
|---|
| 44 | 44 | | (3) job training program for jobs in the health care, |
|---|
| 45 | 45 | | technology, or oil and gas industries; or |
|---|
| 46 | 46 | | (4) project that relates to a public purpose of the |
|---|
| 47 | 47 | | district for which the authority receives a grant through a |
|---|
| 48 | 48 | | competitive grant program administered by the federal government or |
|---|
| 49 | 49 | | this state, including a program administered by the Parks and |
|---|
| 50 | 50 | | Wildlife Department, the Texas Department of Transportation, or the |
|---|
| 51 | 51 | | Texas Workforce Commission. |
|---|
| 52 | 52 | | (b) Notwithstanding Subsection (a), in this subchapter, |
|---|
| 53 | 53 | | seeking a charter for or operating an open-enrollment charter |
|---|
| 54 | 54 | | school authorized by Subchapter D, Chapter 12, Education Code, is |
|---|
| 55 | 55 | | not an eligible project. |
|---|
| 56 | 56 | | SECTION 3. This Act takes effect September 1, 2015. |
