12 | 6 | | involving the Department of Public Safety of the State of Texas. |

13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. (a) Subject to Subsections (b) and (c) of this |
---|
15 | 9 | | section, the Department of Public Safety of the State of Texas may |
---|
16 | 10 | | convey the real property described by Section 2 of this Act to the |
---|
17 | 11 | | First United Pentecostal Church, Center, Texas, in exchange for the |
---|
18 | 12 | | real property described by Section 3 of this Act conveyed by the |
---|
19 | 13 | | First United Pentecostal Church to the Department of Public Safety |
---|
20 | 14 | | of the State of Texas. |
---|
21 | 15 | | (b) The real property described by Section 2 of this Act may |
---|
22 | 16 | | not be conveyed by the Department of Public Safety of the State of |
---|
23 | 17 | | Texas to the First United Pentecostal Church unless the fair market |
---|
24 | 18 | | value of the real property described by Section 3 of this Act is |
---|
25 | 19 | | equal to or greater than the fair market value of the real property |
---|
26 | 20 | | described by Section 2 of this Act. The fair market value of the |
---|
27 | 21 | | real property must be established by an independent appraisal |
---|
28 | 22 | | obtained by the asset management division of the General Land |
---|
29 | 23 | | Office. |
---|
30 | 24 | | (c) In connection with the conveyance of the real property |
---|
31 | 25 | | described by Section 2 of this Act, the state shall reserve: |
---|
32 | 26 | | (1) the state's interest in all oil, gas, and other |
---|
33 | 27 | | minerals in and under the real property described by Section 2 of |
---|
34 | 28 | | this Act; |
---|
35 | 29 | | (2) the state's right to remove from the real property |
---|
36 | 30 | | described by Section 2 of this Act any oil, gas, and other minerals |
---|
37 | 31 | | in and under the real property; and |
---|
38 | 32 | | (3) the state's right to grant a lease held by the |
---|
39 | 33 | | state before a conveyance of the real property described by Section |
---|
40 | 34 | | 2 of this Act relating to the removal of oil, gas, and other |
---|
41 | 35 | | minerals in and under the real property. |
---|
42 | 36 | | (d) The Department of Public Safety of the State of Texas |
---|
43 | 37 | | and the First United Pentecostal Church, Center, Texas, shall each |
---|
44 | 38 | | reimburse the General Land Office for an amount equal to one-half of |
---|
45 | 39 | | the fees and expenses incurred by the General Land Office in |
---|
46 | 40 | | connection with each conveyance of real property under this Act. |
---|
47 | 41 | | (e) Sections 31.1571, 31.158, and 31.159, Natural Resources |
---|
48 | 42 | | Code, do not apply to the exchange of real property authorized by |
---|
49 | 43 | | this Act. |
---|
50 | 44 | | SECTION 2. The real property held by the Department of |
---|
51 | 45 | | Public Safety of the State of Texas is land being situated in Shelby |
---|
52 | 46 | | County, Texas, and more particularly described as follows: |
---|
53 | 47 | | BEING 3.167 acres of land, more or less, out of the J. AMASON |
---|
54 | 48 | | Survey, Abstract No. 10, in Shelby County, Texas, and also being a |
---|
55 | 49 | | portion of and the same tract as described in a deed to the State of |
---|
56 | 50 | | Texas acting through the State Highway Commission from Dr. J. M. |
---|
57 | 51 | | Rogers and wife Cora M. Rogers, dated April 19, 1950, recorded in |
---|
58 | 52 | | Volume 292, Page 513, Deed Records of Shelby County, Texas; said |
