225 relating to Medicaid billing for the services of substitute
236 dentists.
247 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
258 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
269 is amended by adding Section 32.076 to read as follows:
2710 Sec. 32.076. SUBSTITUTE DENTISTS. To the extent allowed by
2811 federal law, the executive commissioner of the Health and Human
2912 Services Commission shall adopt rules ensuring that the same
3013 standards applying to a physician who bills the medical assistance
3114 program for services provided by a substitute physician apply also
3215 to a dentist who bills the medical assistance program for services
3316 provided by a substitute dentist.
3417 SECTION 2. If before implementing any provision of this Act
3518 a state agency determines that a waiver or authorization from a
3619 federal agency is necessary for implementation of that provision,
3720 the agency affected by the provision shall request the waiver or
3821 authorization and may delay implementing that provision until the
3922 waiver or authorization is granted.
4023 SECTION 3. As soon as practicable after the effective date
4124 of this Act, the executive commissioner of the Health and Human
4225 Services Commission shall adopt the rules necessary to implement
4326 the changes in law made by this Act.
4427 SECTION 4. This Act takes effect immediately if it receives
4528 a vote of two-thirds of all the members elected to each house, as
4629 provided by Section 39, Article III, Texas Constitution. If this
4730 Act does not receive the vote necessary for immediate effect, this
4831 Act takes effect September 1, 2015.
