115 relating to reducing paperwork and duplicate reports required of a
126 school district.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 7.060, Education Code, is amended by
159 adding Subsection (a-1) to read as follows:
1610 (a-1) The review conducted under Subsection (a) must
1711 include a comparison of the reports and paperwork required by state
1812 law and the reports and paperwork required by federal law. The
1913 commissioner shall eliminate any reports or paperwork required by
2014 state law that duplicate the content of reports or paperwork also
2115 required by federal law.
2216 SECTION 2. Section 11.201(d), Education Code, is amended to
2317 read as follows:
2418 (d) The duties of the superintendent include:
2519 (1) assuming administrative responsibility and
2620 leadership for the planning, organization, operation, supervision,
2721 and evaluation of the education programs, services, and facilities
2822 of the district and for the annual performance appraisal of the
2923 district's staff;
3024 (2) except as provided by Section 11.202, assuming
3125 administrative authority and responsibility for the assignment,
3226 supervision, and evaluation of all personnel of the district other
3327 than the superintendent;
3428 (3) overseeing compliance with the standards for
3529 school facilities established by the commissioner under Section
3630 46.008;
3731 (4) initiating the termination or suspension of an
3832 employee or the nonrenewal of an employee's term contract;
3933 (5) managing the day-to-day operations of the district
4034 as its administrative manager, including implementing and
4135 monitoring plans, procedures, programs, and systems to achieve
4236 clearly defined and desired results in major areas of district
4337 operations;
4438 (6) preparing and submitting to the board of trustees
4539 a proposed budget as provided by Section 44.002 and rules adopted
4640 under that section, and administering the budget;
4741 (7) preparing recommendations for policies to be
4842 adopted by the board of trustees and overseeing the implementation
4943 of adopted policies;
5044 (8) developing or causing to be developed appropriate
5145 administrative regulations to implement policies established by
5246 the board of trustees;
5347 (9) providing leadership for the attainment and, if
5448 necessary, improvement of student performance in the district based
5549 on the indicators adopted under Sections 39.053 and 39.301 and
5650 other indicators adopted by the commissioner or the district's
5751 board of trustees;
5852 (10) organizing the district's central
5953 administration;
6054 (11) consulting with the district-level committee as
6155 required under Section 11.252(f);
6256 (12) ensuring:
6357 (A) adoption of a student code of conduct as
6458 required under Section 37.001 and enforcement of that code of
6559 conduct; and
6660 (B) adoption and enforcement of other student
6761 disciplinary rules and procedures as necessary;
6862 (13) submitting reports as required by state or
6963 federal law, rule, or regulation, and ensuring that a copy of any
7064 report required by federal law, rule, or regulation is also
7165 delivered to the agency;
7266 (14) providing joint leadership with the board of
7367 trustees to ensure that the responsibilities of the board and
7468 superintendent team are carried out; and
7569 (15) performing any other duties assigned by action of
7670 the board of trustees.
7771 SECTION 3. This Act takes effect immediately if it receives
7872 a vote of two-thirds of all the members elected to each house, as
7973 provided by Section 39, Article III, Texas Constitution. If this
8074 Act does not receive the vote necessary for immediate effect, this
8175 Act takes effect September 1, 2015.
