13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. Section 7.060, Education Code, is amended by |
---|
15 | 9 | | adding Subsection (a-1) to read as follows: |
---|
16 | 10 | | (a-1) The review conducted under Subsection (a) must |
---|
17 | 11 | | include a comparison of the reports and paperwork required by state |
---|
18 | 12 | | law and the reports and paperwork required by federal law. The |
---|
19 | 13 | | commissioner shall eliminate any reports or paperwork required by |
---|
20 | 14 | | state law that duplicate the content of reports or paperwork also |
---|
21 | 15 | | required by federal law. |
---|
22 | 16 | | SECTION 2. Section 11.201(d), Education Code, is amended to |
---|
23 | 17 | | read as follows: |
---|
24 | 18 | | (d) The duties of the superintendent include: |
---|
25 | 19 | | (1) assuming administrative responsibility and |
---|
26 | 20 | | leadership for the planning, organization, operation, supervision, |
---|
27 | 21 | | and evaluation of the education programs, services, and facilities |
---|
28 | 22 | | of the district and for the annual performance appraisal of the |
---|
29 | 23 | | district's staff; |
---|
30 | 24 | | (2) except as provided by Section 11.202, assuming |
---|
31 | 25 | | administrative authority and responsibility for the assignment, |
---|
32 | 26 | | supervision, and evaluation of all personnel of the district other |
---|
33 | 27 | | than the superintendent; |
---|
34 | 28 | | (3) overseeing compliance with the standards for |
---|
35 | 29 | | school facilities established by the commissioner under Section |
---|
36 | 30 | | 46.008; |
---|
37 | 31 | | (4) initiating the termination or suspension of an |
---|
38 | 32 | | employee or the nonrenewal of an employee's term contract; |
---|
39 | 33 | | (5) managing the day-to-day operations of the district |
---|
40 | 34 | | as its administrative manager, including implementing and |
---|
41 | 35 | | monitoring plans, procedures, programs, and systems to achieve |
---|
42 | 36 | | clearly defined and desired results in major areas of district |
---|
43 | 37 | | operations; |
---|
44 | 38 | | (6) preparing and submitting to the board of trustees |
---|
45 | 39 | | a proposed budget as provided by Section 44.002 and rules adopted |
---|
46 | 40 | | under that section, and administering the budget; |
---|
47 | 41 | | (7) preparing recommendations for policies to be |
---|
48 | 42 | | adopted by the board of trustees and overseeing the implementation |
---|
49 | 43 | | of adopted policies; |
---|
50 | 44 | | (8) developing or causing to be developed appropriate |
---|
51 | 45 | | administrative regulations to implement policies established by |
---|
52 | 46 | | the board of trustees; |
---|
53 | 47 | | (9) providing leadership for the attainment and, if |
---|
54 | 48 | | necessary, improvement of student performance in the district based |
---|
55 | 49 | | on the indicators adopted under Sections 39.053 and 39.301 and |
---|
56 | 50 | | other indicators adopted by the commissioner or the district's |
---|
57 | 51 | | board of trustees; |
---|
58 | 52 | | (10) organizing the district's central |
---|
59 | 53 | | administration; |
---|
60 | 54 | | (11) consulting with the district-level committee as |
---|
61 | 55 | | required under Section 11.252(f); |
---|
62 | 56 | | (12) ensuring: |
---|
63 | 57 | | (A) adoption of a student code of conduct as |
---|
64 | 58 | | required under Section 37.001 and enforcement of that code of |
---|
65 | 59 | | conduct; and |
---|
66 | 60 | | (B) adoption and enforcement of other student |
---|
67 | 61 | | disciplinary rules and procedures as necessary; |
---|
68 | 62 | | (13) submitting reports as required by state or |
---|
69 | 63 | | federal law, rule, or regulation, and ensuring that a copy of any |
---|
70 | 64 | | report required by federal law, rule, or regulation is also |
---|
71 | 65 | | delivered to the agency; |
---|
72 | 66 | | (14) providing joint leadership with the board of |
---|
73 | 67 | | trustees to ensure that the responsibilities of the board and |
---|
74 | 68 | | superintendent team are carried out; and |
---|
75 | 69 | | (15) performing any other duties assigned by action of |
---|
76 | 70 | | the board of trustees. |
---|
77 | 71 | | SECTION 3. This Act takes effect immediately if it receives |
---|
78 | 72 | | a vote of two-thirds of all the members elected to each house, as |
---|
79 | 73 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
80 | 74 | | Act does not receive the vote necessary for immediate effect, this |
---|
81 | 75 | | Act takes effect September 1, 2015. |
