| 24 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 25 | 8 | | SECTION 1. Section 109.57(d), Alcoholic Beverage Code, is |
|---|
| 26 | 9 | | amended to read as follows: |
|---|
| 27 | 10 | | (d) This section does not affect the authority of a |
|---|
| 28 | 11 | | governmental entity to regulate, in a manner as otherwise permitted |
|---|
| 29 | 12 | | by law, the location of: |
|---|
| 30 | 13 | | (1) a massage parlor, nude modeling studio, or other |
|---|
| 31 | 14 | | sexually oriented business; [or] |
|---|
| 32 | 15 | | (2) an establishment that derives 75 percent or more |
|---|
| 33 | 16 | | of the establishment's gross revenue from the on-premise sale of |
|---|
| 34 | 17 | | alcoholic beverages; or |
|---|
| 35 | 18 | | (3) an establishment that: |
|---|
| 36 | 19 | | (A) derives 50 percent or more of the |
|---|
| 37 | 20 | | establishment's gross revenue from the on-premise sale of alcoholic |
|---|
| 38 | 21 | | beverages; and |
|---|
| 39 | 22 | | (B) is located in a municipality or county, any |
|---|
| 40 | 23 | | portion of which is located not more than 50 miles from an |
|---|
| 41 | 24 | | international border. |

| 42 | 25 | | SECTION 2. This Act takes effect September 1, 2015. |
