77 relating to fingerprinting requirements for occupational licenses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 2, Occupations Code, is amended by adding
1010 Chapter 60 to read as follows:
1111 CHAPTER 60. FINGERPRINTING REQUIREMENTS
1212 Sec. 60.001. DEFINITIONS. In this chapter:
1313 (1) "License" means a license, certificate,
1414 registration, permit, or other form of authorization required by
1515 law or a state agency rule that must be obtained by an individual to
1616 engage in a particular business.
1717 (2) "State agency" means a department, board, bureau,
1818 commission, committee, division, office, council, or agency of this
1919 state.
2020 Sec. 60.002. FINGERPRINTING OF CERTAIN LICENSE APPLICANTS
2121 PROHIBITED. (a) Notwithstanding any other law and except as
2222 provided by this section, a state agency that issues a license may
2323 not require an applicant for the license to submit fingerprints to
2424 the agency, the Department of Public Safety, or any other person as
2525 a requirement for the issuance or renewal of the license.
2626 (b) This section does not apply to an applicant for a
2727 license issued under Chapter 1701 or 1702.
2828 SECTION 2. Chapter 60, Occupations Code, as added by this
2929 Act, applies only to an application for the issuance or renewal of
3030 an occupational license filed on or after the effective date of this
3131 Act. An application filed before that date is governed by the law
3232 in effect on the date the application was filed, and the former law
3333 is continued in effect for that purpose.
3434 SECTION 3. This Act takes effect September 1, 2015.
