| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Title 2, Occupations Code, is amended by adding |
|---|
| 10 | 10 | | Chapter 60 to read as follows: |
|---|
| 11 | 11 | | CHAPTER 60. FINGERPRINTING REQUIREMENTS |
|---|
| 12 | 12 | | Sec. 60.001. DEFINITIONS. In this chapter: |
|---|
| 13 | 13 | | (1) "License" means a license, certificate, |
|---|
| 14 | 14 | | registration, permit, or other form of authorization required by |
|---|
| 15 | 15 | | law or a state agency rule that must be obtained by an individual to |
|---|
| 16 | 16 | | engage in a particular business. |
|---|
| 17 | 17 | | (2) "State agency" means a department, board, bureau, |
|---|
| 18 | 18 | | commission, committee, division, office, council, or agency of this |
|---|
| 19 | 19 | | state. |
|---|
| 20 | 20 | | Sec. 60.002. FINGERPRINTING OF CERTAIN LICENSE APPLICANTS |
|---|
| 21 | 21 | | PROHIBITED. (a) Notwithstanding any other law and except as |
|---|
| 22 | 22 | | provided by this section, a state agency that issues a license may |
|---|
| 23 | 23 | | not require an applicant for the license to submit fingerprints to |
|---|
| 24 | 24 | | the agency, the Department of Public Safety, or any other person as |
|---|
| 25 | 25 | | a requirement for the issuance or renewal of the license. |
|---|
| 26 | 26 | | (b) This section does not apply to an applicant for a |
|---|
| 27 | 27 | | license issued under Chapter 1701 or 1702. |
|---|
| 28 | 28 | | SECTION 2. Chapter 60, Occupations Code, as added by this |
|---|
| 29 | 29 | | Act, applies only to an application for the issuance or renewal of |
|---|
| 30 | 30 | | an occupational license filed on or after the effective date of this |
|---|
| 31 | 31 | | Act. An application filed before that date is governed by the law |
|---|
| 32 | 32 | | in effect on the date the application was filed, and the former law |
|---|
| 33 | 33 | | is continued in effect for that purpose. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2015. |
