 A BILL TO BE ENTITLED
 AN ACT
 relating to fingerprinting requirements for occupational licenses.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Title 2, Occupations Code, is amended by adding
 Chapter 60 to read as follows:
 CHAPTER 60. FINGERPRINTING REQUIREMENTS
 Sec. 60.001.  DEFINITIONS. In this chapter:
 (1)  "License" means a license, certificate,
 registration, permit, or other form of authorization required by
 law or a state agency rule that must be obtained by an individual to
 engage in a particular business.
 (2)  "State agency" means a department, board, bureau,
 commission, committee, division, office, council, or agency of this
 state.
 Sec. 60.002.  FINGERPRINTING OF CERTAIN LICENSE APPLICANTS
 PROHIBITED. (a)  Notwithstanding any other law and except as
 provided by this section, a state agency that issues a license may
 not require an applicant for the license to submit fingerprints to
 the agency, the Department of Public Safety, or any other person as
 a requirement for the issuance or renewal of the license.
 (b)  This section does not apply to an applicant for a
 license issued under Chapter 1701 or 1702.
 SECTION 2.  Chapter 60, Occupations Code, as added by this
 Act, applies only to an application for the issuance or renewal of
 an occupational license filed on or after the effective date of this
 Act. An application filed before that date is governed by the law
 in effect on the date the application was filed, and the former law
 is continued in effect for that purpose.
 SECTION 3.  This Act takes effect September 1, 2015.
