The bill would reenact Article 46B.010, Code of Criminal Procedure, regarding the mandatory dismissal of misdemeanor charges against defendants determined to be incompetent to stand trial and ordered to participate in mental health treatment. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
