66 AN ACT
77 relating to the requirements for employment positions provided
88 through the Texas college work-study program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 56.076, Education Code, is amended to
1111 read as follows:
1212 Sec. 56.076. ELIGIBLE EMPLOYER. (a) An eligible
1313 institution may enter into agreements with employers that
1414 participate in the work-study program. To be eligible to
1515 participate in the work-study program, an employer must:
1616 (1) provide part-time employment to an eligible
1717 student in nonpartisan and nonsectarian activities;
1818 (2) provide, insofar as is practicable, employment to
1919 an eligible student that is related to the student's academic
2020 interests;
2121 (3) use Texas college work-study program positions
2222 only to supplement and not to supplant positions normally filled by
2323 persons not eligible to participate in the work-study program;
2424 (4) provide from sources other than federal college
2525 work-study program funds a percentage of an employed student's
2626 wages that is equal to the percentage of a student's wages that the
2727 employer would be required to provide to the student in that
2828 academic year under the federal college work-study program; and
2929 (5) provide from sources other than federal college
3030 work-study funds 100 percent of other employee benefits for the
3131 employed student.
3232 (b) Each eligible institution shall ensure that 50 percent
3333 of the employment positions provided through the work-study program
3434 in an academic year are provided by employers eligible under this
3535 section who are providing employment located off campus.
3636 SECTION 2. Section 56.079(l), Education Code, is amended to
3737 read as follows:
3838 (l) Notwithstanding Section 56.076(a) [56.076], a
3939 participating entity that employs a student mentor under the
4040 work-study student mentorship program shall provide from sources
4141 other than federal college work-study funds:
4242 (1) not less than 10 percent of the employed student's
4343 wages; and
4444 (2) 100 percent of other employee benefits for the
4545 employed student.
4646 SECTION 3. The changes in law made by this Act apply to
4747 participation in the Texas college work-study program beginning
4848 with the 2016-2017 academic year.
4949 SECTION 4. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2015.
