1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to railroads in this state.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 81.001, Transportation Code, is amended
1616 by adding Subdivision (3) to read as follows:
1717 (3) "High-speed rail" means intercity passenger rail
1818 service that is reasonably expected to reach speeds of at least 110
1919 miles per hour.
2020 SECTION 2. Section 81.002, Transportation Code, is amended
2121 to read as follows:
2222 Sec. 81.002. APPLICABILITY. In this title, a reference to a
2323 railroad company means [includes]:
2424 (1) a railroad initially incorporated before
2525 September 1, 2007, under former Title 112, Revised Statutes; or
2626 (2) any other legal entity operating a railroad,
2727 including an entity organized under the Texas Business Corporation
2828 Act or the Texas Corporation Law provisions of the Business
2929 Organizations Code, that owns or leases:
3030 (A) locomotives and passenger or freight rail
3131 cars; and
3232 (B) rights-of-way used for the purposes of
3333 transporting people or goods by rail between at least two
3434 terminuses.
3535 SECTION 3. Section 112.002, Transportation Code, is amended
3636 by adding Subsection (c) to read as follows:
3737 (c) Notwithstanding Subsection (b)(5), a company that
3838 operates a high-speed rail system may not exercise the power of
3939 eminent domain for the system.
4040 SECTION 4. Section 111.103(a), Transportation Code, is
4141 repealed.
4242 SECTION 5. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2015.
