114 A BILL TO BE ENTITLED
125 AN ACT
136 relating to the authority of the Public Utility Commission of Texas
147 to restrict participation in the retail electric market for
158 significant violations.
169 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1710 SECTION 1. Section 39.356, Utilities Code, is amended by
1811 adding Subsection (a-1) to read as follows:
1912 (a-1) If the commission suspends, revokes, or amends a
2013 retail electric provider's certificate under Subsection (a), the
2114 commission may, after notice and opportunity for hearing, prohibit
2215 an individual who is a principal or executive officer of the retail
2316 electric provider and who knew or reasonably should have known of
2417 the acts or omissions described by Subsection (a) that led to the
2518 suspension, revocation, or amendment of the certificate from
2619 participating in the retail electric market in Texas through
2720 ownership of or seeking employment by a retail electric provider,
2821 electric utility, billing agent, billing utility, aggregator, or
2922 person who assists in selection of a retail electric provider.
3023 SECTION 2. This Act takes effect immediately if it receives
3124 a vote of two-thirds of all the members elected to each house, as
3225 provided by Section 39, Article III, Texas Constitution. If this
3326 Act does not receive the vote necessary for immediate effect, this
3427 Act takes effect September 1, 2015.
