16 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

17 | 10 | | SECTION 1. Section 39.356, Utilities Code, is amended by |
---|
18 | 11 | | adding Subsection (a-1) to read as follows: |

19 | 12 | | (a-1) If the commission suspends, revokes, or amends a |
---|
20 | 13 | | retail electric provider's certificate under Subsection (a), the |
---|
21 | 14 | | commission may, after notice and opportunity for hearing, prohibit |
---|
22 | 15 | | an individual who is a principal or executive officer of the retail |
---|
23 | 16 | | electric provider and who knew or reasonably should have known of |
---|
24 | 17 | | the acts or omissions described by Subsection (a) that led to the |
---|
25 | 18 | | suspension, revocation, or amendment of the certificate from |
---|
26 | 19 | | participating in the retail electric market in Texas through |
---|
27 | 20 | | ownership of or seeking employment by a retail electric provider, |
---|
28 | 21 | | electric utility, billing agent, billing utility, aggregator, or |
---|
29 | 22 | | person who assists in selection of a retail electric provider. |
---|
30 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
---|
31 | 24 | | a vote of two-thirds of all the members elected to each house, as |
---|
32 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
33 | 26 | | Act does not receive the vote necessary for immediate effect, this |
---|
34 | 27 | | Act takes effect September 1, 2015. |
