99 relating to energy and water management planning and reporting
1010 requirements for state agencies and institutions of higher
1111 education.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 447.009, Government Code, is amended to
1414 read as follows:
1515 Sec. 447.009. ENERGY AND WATER MANAGEMENT PLANNING;
1616 REPORTING. (a) The state energy conservation office shall provide
1717 energy and water management planning assistance to a state agency
1818 or an institution of higher education, including assistance to:
1919 (1) [preparation by the agency or institution of a
2020 long-range plan for the delivery of reliable, cost-effective
2121 utility services for the state agency or institution;
2222 [(2) assistance to] the Department of Public Safety
2323 for energy emergency contingency planning, using state or federal
2424 funds when available; and
2525 (2) [(3) assistance to] each state agency or
2626 institution of higher education in preparing comprehensive energy
2727 and water management plans[; and
2828 [(4) assistance to state agencies other than
2929 institutions of higher education in meeting the requirements of
3030 Section 447.002, including assistance in scheduling and assigning
3131 priorities to implementation plans to ensure that state agencies
3232 adopt qualified cost-effective efficiency measures and programs
3333 for all state facilities not later than September 1, 2006].
3434 (b) [A state agency or an institution of higher education
3535 shall develop the plan described in Subsection (a)(1) and submit
3636 the plan to the state energy conservation office upon request. The
3737 agency or institution shall use the plan in preparing its five-year
3838 construction and major renovation plans. After other energy-saving
3939 or water-saving alternatives are considered, district heating and
4040 cooling or on-site generation of electricity may be considered in
4141 planning for reliable, efficient, and cost-effective utility
4242 services.
4343 [(c)] The state energy conservation office shall prepare
4444 guidelines for preparation of the plan described in Subsection
4545 (a)(2) [(a)(3)] and develop a template for state agencies and
4646 institutions of higher education to use in creating the plan. Each
4747 state agency and institution of higher education shall set
4848 percentage goals for reducing the agency's or institution's use of
4949 water, electricity, transportation fuel [gasoline], and natural
5050 gas and include those goals in the agency's or institution's
5151 comprehensive energy and water management plan. [A state agency or
5252 an institution of higher education that occupies a state-owned
5353 building shall prepare and implement a five-year energy and water
5454 management plan and shall submit that plan to the office upon
5555 request. The agency or institution shall update its plan annually.
5656 A state agency or an institution of higher education that occupies a
5757 building not owned by the state shall cooperate with the office in
5858 addressing the energy or water management of that building.]
5959 (c) [(d)] The comprehensive energy and water management
6060 plan described in Subsection (a)(2) [(a)(3)] shall be included in
6161 the five-year construction and major repair and rehabilitation
6262 plans for institutions of higher education as required by Section
6363 61.0651, Education Code.
6464 (d) [(e)] Not later than January 15 [December 1] of each
6565 odd-numbered [even-numbered] year, the state energy conservation
6666 office shall submit a report to the governor and the Legislative
6767 Budget Board on the status and effectiveness of the utility
6868 management and conservation efforts of state agencies and
6969 institutions of higher education. The report must include
7070 information submitted to the office from each state agency and
7171 institution of higher education. The office shall post the report
7272 on the office's Internet website.
7373 SECTION 2. Section 2166.409, Government Code, is repealed.
7474 SECTION 3. This Act takes effect September 1, 2015.
