9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 403, Occupations Code, is |
---|
11 | 11 | | amended by adding Section 403.004 to read as follows: |
---|
12 | 12 | | Sec. 403.004. EXEMPTION FROM LICENSING REQUIREMENT FOR |
---|
13 | 13 | | SUPERVISED ACTIVITIES AND SERVICES. Section 403.101(b) does not |
---|
14 | 14 | | apply to the activities and services of a person who is completing |
---|
15 | 15 | | supervised clinical experience as required by Section |
---|
16 | 16 | | 403.105(a)(3), to the extent that the activities and services |
---|
17 | 17 | | satisfy the requirements of Section 403.105(b). |
---|
18 | 18 | | SECTION 2. Section 403.101, Occupations Code, is amended to |
---|
19 | 19 | | read as follows: |
---|
20 | 20 | | Sec. 403.101. LICENSE REQUIRED. (a) A person may not use |
---|
21 | 21 | | the title "licensed dyslexia practitioner" or "licensed dyslexia |
---|
22 | 22 | | therapist" in this state unless the person holds the appropriate |
---|
23 | 23 | | license under this chapter. |
---|
24 | 24 | | (b) A person may not provide multisensory structured |
---|
25 | 25 | | language education or dyslexia therapy services outside of an |
---|
26 | 26 | | educational setting, including a school, learning center, or |
---|
27 | 27 | | clinic, unless the person holds a licensed dyslexia therapist |
---|
28 | 28 | | license. |
---|
29 | 29 | | SECTION 3. Subchapter C, Chapter 403, Occupations Code, is |
---|
30 | 30 | | amended by adding Section 403.111 to read as follows: |
---|
31 | 31 | | Sec. 403.111. TEMPORARY DYSLEXIA THERAPIST LICENSE. (a) |
---|
32 | 32 | | The department shall issue a temporary dyslexia therapist license |
---|
33 | 33 | | to an applicant who satisfies all eligibility requirements under |
---|
34 | 34 | | Section 403.105, other than the education required by Section |
---|
35 | 35 | | 403.105(a)(1). |
---|
36 | 36 | | (b) A temporary license is valid until the earlier of: |
---|
37 | 37 | | (1) September 1, 2022; or |
---|
38 | 38 | | (2) the date on which the department issues a licensed |
---|
39 | 39 | | dyslexia therapist license to the applicant. |
---|
40 | 40 | | (c) The department shall issue a licensed dyslexia |
---|
41 | 41 | | therapist license to the holder of a temporary license under this |
---|
42 | 42 | | section if the temporary license holder satisfies the requirement |
---|
43 | 43 | | under Section 403.105(a)(1). |
---|
44 | 44 | | (d) This section expires January 1, 2023. |
---|
45 | 45 | | SECTION 4. Section 403.151(b), Occupations Code, is amended |
---|
46 | 46 | | to read as follows: |
---|
47 | 47 | | (b) A licensed dyslexia therapist may practice in any [a |
---|
48 | 48 | | school, learning center, clinic, or private practice] setting. |
---|
49 | 49 | | SECTION 5. The changes in law made by this Act apply only to |
---|
50 | 50 | | conduct that occurs on or after the effective date of this Act. |
---|
51 | 51 | | Conduct that occurs before the effective date of this Act is |
---|
52 | 52 | | governed by the law in effect on the date the conduct occurred, and |
---|
53 | 53 | | the former law is continued in effect for that purpose. |
---|
54 | 54 | | SECTION 6. (a) Except as provided by Subsection (b) of this |
---|
55 | 55 | | section, this Act takes effect September 1, 2017. |
---|
56 | 56 | | (b) Section 403.101(b), Occupations Code, as added by this |
---|
57 | 57 | | Act, takes effect January 1, 2018. |
