77 relating to the requirement that a person obtain a dyslexia
88 therapist license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 403, Occupations Code, is
1111 amended by adding Section 403.004 to read as follows:
1212 Sec. 403.004. EXEMPTION FROM LICENSING REQUIREMENT FOR
1313 SUPERVISED ACTIVITIES AND SERVICES. Section 403.101(b) does not
1414 apply to the activities and services of a person who is completing
1515 supervised clinical experience as required by Section
1616 403.105(a)(3), to the extent that the activities and services
1717 satisfy the requirements of Section 403.105(b).
1818 SECTION 2. Section 403.101, Occupations Code, is amended to
1919 read as follows:
2020 Sec. 403.101. LICENSE REQUIRED. (a) A person may not use
2121 the title "licensed dyslexia practitioner" or "licensed dyslexia
2222 therapist" in this state unless the person holds the appropriate
2323 license under this chapter.
2424 (b) A person may not provide multisensory structured
2525 language education or dyslexia therapy services outside of an
2626 educational setting, including a school, learning center, or
2727 clinic, unless the person holds a licensed dyslexia therapist
2828 license.
2929 SECTION 3. Subchapter C, Chapter 403, Occupations Code, is
3030 amended by adding Section 403.111 to read as follows:
3131 Sec. 403.111. TEMPORARY DYSLEXIA THERAPIST LICENSE. (a)
3232 The department shall issue a temporary dyslexia therapist license
3333 to an applicant who satisfies all eligibility requirements under
3434 Section 403.105, other than the education required by Section
3535 403.105(a)(1).
3636 (b) A temporary license is valid until the earlier of:
3737 (1) September 1, 2022; or
3838 (2) the date on which the department issues a licensed
3939 dyslexia therapist license to the applicant.
4040 (c) The department shall issue a licensed dyslexia
4141 therapist license to the holder of a temporary license under this
4242 section if the temporary license holder satisfies the requirement
4343 under Section 403.105(a)(1).
4444 (d) This section expires January 1, 2023.
4545 SECTION 4. Section 403.151(b), Occupations Code, is amended
4646 to read as follows:
4747 (b) A licensed dyslexia therapist may practice in any [a
4848 school, learning center, clinic, or private practice] setting.
4949 SECTION 5. The changes in law made by this Act apply only to
5050 conduct that occurs on or after the effective date of this Act.
5151 Conduct that occurs before the effective date of this Act is
5252 governed by the law in effect on the date the conduct occurred, and
5353 the former law is continued in effect for that purpose.
5454 SECTION 6. (a) Except as provided by Subsection (b) of this
5555 section, this Act takes effect September 1, 2017.
5656 (b) Section 403.101(b), Occupations Code, as added by this
5757 Act, takes effect January 1, 2018.
