104 AN ACT
115 relating to the participation by qualified persons in the
126 Department of Public Safety's driver record monitoring pilot
137 program.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Sections 521.062, Transportation Code, is
1610 amended by amending Subsections (b) and (j) and adding Subsections
1711 (b-1) and (b-2) to read as follows:
1812 (b) Under the pilot program, the department shall:
1913 (1) [may] enter into a contract with any [a] person
2014 qualified to provide driver record monitoring services, as
2115 described by Subsection (c); [,] and
2216 (2) provide certain information from the department's
2317 driver's license records to the person as provided by this section.
2418 (b-1) A person is qualified to provide driver record
2519 monitoring services [,] if the person:
2620 (1) has submitted an application to the department;
2721 (2) [(1)] is an employer, an insurer, an insurance
2822 support organization, an employer support organization, or an
2923 entity that self-insures its motor vehicles; and
3024 (3) [(2)] is eligible to receive the information under
3125 Chapter 730.
3226 (b-2) The department may not limit the number of qualified
3327 persons participating in the pilot program.
3428 (j) The department shall accept and consider applications
3529 [may establish a reasonable deadline by which a person must apply]
3630 to enter into a contract with the department under this section
3731 until the conclusion of the term of the pilot program [and may not
3832 enter into a contract with a person who fails to apply before that
3933 deadline].
4034 SECTION 2. This Act takes effect immediately if it receives
4135 a vote of two-thirds of all the members elected to each house, as
4236 provided by Section 39, Article III, Texas Constitution. If this
4337 Act does not receive the vote necessary for immediate effect, this
4438 Act takes effect September 1, 2017.
