12 | 6 | | Department of Public Safety's driver record monitoring pilot |

14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 9 | | SECTION 1. Sections 521.062, Transportation Code, is |
---|
16 | 10 | | amended by amending Subsections (b) and (j) and adding Subsections |
---|
17 | 11 | | (b-1) and (b-2) to read as follows: |
---|
18 | 12 | | (b) Under the pilot program, the department shall: |
---|
19 | 13 | | (1) [may] enter into a contract with any [a] person |
---|
20 | 14 | | qualified to provide driver record monitoring services, as |
---|
21 | 15 | | described by Subsection (c); [,] and |
---|
22 | 16 | | (2) provide certain information from the department's |
---|
23 | 17 | | driver's license records to the person as provided by this section. |
---|
24 | 18 | | (b-1) A person is qualified to provide driver record |
---|
25 | 19 | | monitoring services [,] if the person: |
---|
26 | 20 | | (1) has submitted an application to the department; |
---|
27 | 21 | | (2) [(1)] is an employer, an insurer, an insurance |
---|
28 | 22 | | support organization, an employer support organization, or an |
---|
29 | 23 | | entity that self-insures its motor vehicles; and |
---|
30 | 24 | | (3) [(2)] is eligible to receive the information under |
---|
31 | 25 | | Chapter 730. |
---|
32 | 26 | | (b-2) The department may not limit the number of qualified |
---|
33 | 27 | | persons participating in the pilot program. |
---|
34 | 28 | | (j) The department shall accept and consider applications |
---|
35 | 29 | | [may establish a reasonable deadline by which a person must apply] |
---|
36 | 30 | | to enter into a contract with the department under this section |
---|
37 | 31 | | until the conclusion of the term of the pilot program [and may not |
---|
38 | 32 | | enter into a contract with a person who fails to apply before that |
---|
39 | 33 | | deadline]. |
---|
40 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
---|
41 | 35 | | a vote of two-thirds of all the members elected to each house, as |
---|
42 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
43 | 37 | | Act does not receive the vote necessary for immediate effect, this |
---|
44 | 38 | | Act takes effect September 1, 2017. |
