124 AN ACT
135 relating to contract requirements for prescription drug benefits
146 provided by Medicaid managed care organizations.
157 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
168 SECTION 1. Section 533.005(a-1), Government Code, is
179 amended to read as follows:
1810 (a-1) The requirements imposed by Subsections (a)(23)(A),
1911 (B), and (C) do not apply, and may not be enforced, on and after
2012 August 31, 2023 [2018].
2113 SECTION 2. If before implementing any provision of this Act
2214 a state agency determines that a waiver or authorization from a
2315 federal agency is necessary for implementation of that provision,
2416 the agency affected by the provision shall request the waiver or
2517 authorization and may delay implementing that provision until the
2618 waiver or authorization is granted.
2719 SECTION 3. This Act takes effect immediately if it receives
2820 a vote of two-thirds of all the members elected to each house, as
2921 provided by Section 39, Article III, Texas Constitution. If this
3022 Act does not receive the vote necessary for immediate effect, this
3123 Act takes effect September 1, 2017.
