10	4		AN ACT
11	5		relating to a report regarding the confinement of pregnant inmates
12	6		by the Texas Department of Criminal Justice.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. (a) In this section, "department" means the
15	9		Texas Department of Criminal Justice.
16	10		(b) The department shall prepare a report on the confinement
17	11		of pregnant inmates in facilities operated by or under contract
18	12		with the department. The report must include:
19	13		(1) a description of the department's implementation
20	14		of policies and procedures to provide adequate care to pregnant
21	15		inmates while confined in a facility operated by or under contract
22	16		with the department, and any policies adopted by the department
23	17		regarding the placement of a pregnant inmate in administrative
24	18		segregation;
25	19		(2) information regarding the health care provided to
26	20		a pregnant inmate, including the availability of:
27	21		(A) obstetrical or gynecological care;
28	22		(B) prenatal health care visits;
29	23		(C) mental health care; and
30	24		(D) drug abuse or chemical dependency treatment;
31	25		(3) a detailed summary of the following as applicable
32	26		to pregnant inmates:
33	27		(A) nutritional standards, including the average
34	28		caloric intake of a pregnant inmate and other dietary information;
35	29		(B) work assignments;
36	30		(C) housing conditions; and
37	31		(D) situations in which a pregnant inmate has
38	32		been restrained, including the reason a determination to use
39	33		restraints was made under Section 501.066, Government Code; and
40	34		(4) the number of miscarriages experienced by pregnant
41	35		inmates while confined in a facility operated by or under contract
42	36		with the department between September 1, 2017, and September 1,
43	37		2018.
44	38		(c) Not later than December 1, 2018, the department shall
45	39		provide a copy of the report to:
46	40		(1) the governor;
47	41		(2) the lieutenant governor;
48	42		(3) the speaker of the house of representatives; and
49	43		(4) each standing committee of the senate and house of
50	44		representatives having primary jurisdiction over matters relating
51	45		to corrections.
52	46		SECTION 2. This Act expires February 1, 2019.
53	47		SECTION 3. This Act takes effect September 1, 2017.
