55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of the Texas Historical Commission.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 442.002(b), Government Code, is amended
1010 to read as follows:
1111 (b) The commission is composed of 15 [nine] members
1212 appointed by the governor with the advice and consent of the senate.
1313 One member must be a professional archeologist, one must be a
1414 professional historian, and one must be a professional architect
1515 who is licensed in this state and has expertise in historic
1616 preservation and architectural history. The remaining members must
1717 represent the general public. A person is [may] not eligible for
1818 appointment as [be] a member of the commission if the person or the
1919 person's spouse:
2020 (1) owns or controls, directly or indirectly, more
2121 than a 10 percent interest in a business entity or other
2222 organization regulated by the commission or receiving money other
2323 than grant money from the commission;
2424 (2) uses or receives a substantial amount of tangible
2525 goods, services, or money from the commission, other than
2626 compensation or reimbursement authorized by law for commission
2727 membership, attendance, or expenses; or
2828 (3) is employed by or participates in the management
2929 of a business entity or other organization regulated by or
3030 receiving money other than grant money from the commission.
3131 SECTION 2. As soon as practicable after the effective date
3232 of this Act, the governor shall appoint six additional members to
3333 the Texas Historical Commission as required by Section 442.002(b),
3434 Government Code, as amended by this Act. In appointing the
3535 additional members to the commission, the governor shall appoint:
3636 (1) two members, including one professional
3737 archeologist member, to terms expiring February 1, 2019;
3838 (2) two members, including one professional historian
3939 member, to terms expiring February 1, 2021; and
4040 (3) two members, including one licensed architect
4141 member, to terms expiring February 1, 2023.
4242 SECTION 3. This Act takes effect September 1, 2017.
