| 7 | 7 | | relating to the composition of the Texas Historical Commission. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 442.002(b), Government Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (b) The commission is composed of 15 [nine] members |
|---|
| 12 | 12 | | appointed by the governor with the advice and consent of the senate. |
|---|
| 13 | 13 | | One member must be a professional archeologist, one must be a |
|---|
| 14 | 14 | | professional historian, and one must be a professional architect |
|---|
| 15 | 15 | | who is licensed in this state and has expertise in historic |
|---|
| 16 | 16 | | preservation and architectural history. The remaining members must |
|---|
| 17 | 17 | | represent the general public. A person is [may] not eligible for |
|---|
| 18 | 18 | | appointment as [be] a member of the commission if the person or the |
|---|
| 19 | 19 | | person's spouse: |
|---|
| 20 | 20 | | (1) owns or controls, directly or indirectly, more |
|---|
| 21 | 21 | | than a 10 percent interest in a business entity or other |
|---|
| 22 | 22 | | organization regulated by the commission or receiving money other |
|---|
| 23 | 23 | | than grant money from the commission; |
|---|
| 24 | 24 | | (2) uses or receives a substantial amount of tangible |
|---|
| 25 | 25 | | goods, services, or money from the commission, other than |
|---|
| 26 | 26 | | compensation or reimbursement authorized by law for commission |
|---|
| 27 | 27 | | membership, attendance, or expenses; or |
|---|
| 28 | 28 | | (3) is employed by or participates in the management |
|---|
| 29 | 29 | | of a business entity or other organization regulated by or |
|---|
| 30 | 30 | | receiving money other than grant money from the commission. |
|---|
| 31 | 31 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 32 | 32 | | of this Act, the governor shall appoint six additional members to |
|---|
| 33 | 33 | | the Texas Historical Commission as required by Section 442.002(b), |
|---|
| 34 | 34 | | Government Code, as amended by this Act. In appointing the |
|---|
| 35 | 35 | | additional members to the commission, the governor shall appoint: |
|---|
| 36 | 36 | | (1) two members, including one professional |
|---|
| 37 | 37 | | archeologist member, to terms expiring February 1, 2019; |
|---|
| 38 | 38 | | (2) two members, including one professional historian |
|---|
| 39 | 39 | | member, to terms expiring February 1, 2021; and |
|---|
| 40 | 40 | | (3) two members, including one licensed architect |
|---|
| 41 | 41 | | member, to terms expiring February 1, 2023. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2017. |
