| 13 | 5 | | relating to the composition of the board of directors of a |
|---|
| 14 | 6 | | stormwater control and recapture planning authority in certain |
|---|
| 15 | 7 | | counties. |
|---|
| 16 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 17 | 9 | | SECTION 1. Section 391A.004, Local Government Code, is |
|---|
| 18 | 10 | | amended to read as follows: |
|---|
| 19 | 11 | | Sec. 391A.004. BOARD OF DIRECTORS. (a) The governing body |
|---|
| 20 | 12 | | of an authority is a board of directors composed of: |
|---|
| 21 | 13 | | (1) a representative of the county in which the |
|---|
| 22 | 14 | | authority is located and each municipality within the territory of |
|---|
| 23 | 15 | | the authority; |
|---|
| 24 | 16 | | (2) a representative of each water utility within the |
|---|
| 25 | 17 | | territory of the authority not also described by Subdivision (1); |
|---|
| 26 | 18 | | (3) a representative of each water district within the |
|---|
| 27 | 19 | | territory of the authority that has been in operation for at least |
|---|
| 28 | 20 | | 15 years; [and] |
|---|
| 29 | 21 | | (4) a member appointed by each member of the state |
|---|
| 30 | 22 | | legislature whose legislative district is wholly or partly in the |
|---|
| 31 | 23 | | territory of the authority; and |
|---|
| 32 | 24 | | (5) a representative of the Texas Department of |
|---|
| 33 | 25 | | Transportation appointed by the Texas Transportation Commission. |
|---|
| 34 | 26 | | (b) A person may not serve as a director if the person holds |
|---|
| 35 | 27 | | another public office. |
|---|
| 36 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 37 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 32 | | Act takes effect September 1, 2017. |
