1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the relationship between public employers and fire and
1313 police employees.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 174.002(a), Local Government Code, is
1616 amended to read as follows:
1717 (a) The policy of this state is that a political subdivision
1818 shall provide its fire fighters and police officers with
1919 compensation and other conditions of employment that are
2020 substantially equal to [the same as] compensation and other
2121 conditions of employment that prevail [prevailing] in comparable
2222 fire and police departments [private sector employment].
2323 SECTION 2. Section 174.021, Local Government Code, is
2424 amended to read as follows:
2525 Sec. 174.021. COMPENSATION [PREVAILING WAGE] AND WORKING
2626 CONDITIONS REQUIRED. A political subdivision that employs fire
2727 fighters, police officers, or both, shall provide those employees
2828 with compensation and other conditions of employment that are[:
2929 [(1)] substantially equal to compensation and other
3030 conditions of employment that prevail in comparable fire or police
3131 departments, as applicable [employment in the private sector; and
3232 [(2) based on prevailing private sector compensation
3333 and conditions of employment in the labor market area in other jobs
3434 that require the same or similar skills, ability, and training and
3535 may be performed under the same or similar conditions].
3636 SECTION 3. This Act takes effect September 1, 2017.
