| 7 | 7 | | mobility authority comprehensive development agreements. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 223.201(i) and (j), Transportation |
|---|
| 10 | 10 | | Code, are amended to read as follows: |
|---|
| 11 | 11 | | (i) The authority to enter into a comprehensive development |
|---|
| 12 | 12 | | agreement expires: |
|---|
| 13 | 13 | | (1) August 31, 2021 [2017], for a project described by |
|---|
| 14 | 14 | | Subsection (f), other than the State Highway 99 (Grand Parkway) |
|---|
| 15 | 15 | | project and the State Highway 183 managed lanes project; and |
|---|
| 16 | 16 | | (2) August 31, 2015, for the State Highway 183 managed |
|---|
| 17 | 17 | | lanes project. |
|---|
| 18 | 18 | | (j) Before the department may enter into a comprehensive |
|---|
| 19 | 19 | | development agreement under Subsection (f), the department must: |
|---|
| 20 | 20 | | (1) for a project other than the State Highway 99 |
|---|
| 21 | 21 | | (Grand Parkway) project, obtain[, not later than August 31, 2017,] |
|---|
| 22 | 22 | | the appropriate environmental clearance: |
|---|
| 23 | 23 | | (A) for the project; or |
|---|
| 24 | 24 | | (B) for the initial or base scope of the project |
|---|
| 25 | 25 | | if the project agreement provides for the phased construction of |
|---|
| 26 | 26 | | the project; and |
|---|
| 27 | 27 | | (2) present to the commission a full financial plan |
|---|
| 28 | 28 | | for the project, including costing methodology and cost proposals. |

| 29 | 29 | | SECTION 2. Sections 223.2011(b) and (f), Transportation |
|---|
| 30 | 30 | | Code, are amended to read as follows: |
|---|
| 31 | 31 | | (b) Before the department or an authority may enter into a |
|---|
| 32 | 32 | | comprehensive development agreement under this section, the |
|---|
| 33 | 33 | | department or the authority, as applicable, must: |
|---|
| 34 | 34 | | (1) obtain the appropriate environmental clearance: |
|---|
| 35 | 35 | | (A) for the project; or |
|---|
| 36 | 36 | | (B) for the initial or base scope of the project |
|---|
| 37 | 37 | | if the project agreement provides for the phased construction of |
|---|
| 38 | 38 | | the project; and |
|---|
| 39 | 39 | | (2) present to the commission a full financial plan |
|---|
| 40 | 40 | | for the project, including costing methodology and cost proposals |
|---|
| 41 | 41 | | [meet the requirements under Section 223.201(j)]. |
|---|
| 42 | 42 | | (f) The authority to enter into a comprehensive development |
|---|
| 43 | 43 | | agreement under Subsection (a) [this section] expires August 31, |
|---|
| 44 | 44 | | 2021 [2017]. |
|---|
| 45 | 45 | | SECTION 3. Sections 223.201(k) and 223.2011(c), |
|---|
| 46 | 46 | | Transportation Code, are repealed. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect August 30, 2017. |
