1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the civil prosecution of offenses involving certain
1313 municipal parking ordinances; authorizing a civil fine.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 601.001, Local Government Code, is
1616 amended to read as follows:
1717 Sec. 601.001. PARKING ON PRIVATE PROPERTY. (a) A
1818 municipality by ordinance may regulate the parking of motor
1919 vehicles on private property and may enforce the ordinance in the
2020 same manner that it enforces ordinances regulating parking in
2121 public no-parking zones, including the impoundment of offending
2222 vehicles.
2323 (b) As provided by Chapter 682, Transportation Code, a
2424 municipality with a population of 1.9 million or more may:
2525 (1) declare the violation of a municipal ordinance
2626 relating to the parking of an unattended motor vehicle in the front
2727 or side yard of a single-family residence in a residential area to
2828 be a civil offense; and
2929 (2) by ordinance establish an administrative
3030 adjudication hearing procedure under which a civil fine may be
3131 imposed.
3232 SECTION 2. This Act takes effect September 1, 2017.
