12 | 12 | | relating to the civil prosecution of offenses involving certain |

13 | 13 | | municipal parking ordinances; authorizing a civil fine. |

14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Section 601.001, Local Government Code, is |
---|
16 | 16 | | amended to read as follows: |

17 | 17 | | Sec. 601.001. PARKING ON PRIVATE PROPERTY. (a) A |
---|
18 | 18 | | municipality by ordinance may regulate the parking of motor |
---|
19 | 19 | | vehicles on private property and may enforce the ordinance in the |
---|
20 | 20 | | same manner that it enforces ordinances regulating parking in |
---|
21 | 21 | | public no-parking zones, including the impoundment of offending |
---|
22 | 22 | | vehicles. |

23 | 23 | | (b) As provided by Chapter 682, Transportation Code, a |
---|
24 | 24 | | municipality with a population of 1.9 million or more may: |
---|
25 | 25 | | (1) declare the violation of a municipal ordinance |
---|
26 | 26 | | relating to the parking of an unattended motor vehicle in the front |
---|
27 | 27 | | or side yard of a single-family residence in a residential area to |
---|
28 | 28 | | be a civil offense; and |
---|
29 | 29 | | (2) by ordinance establish an administrative |
---|
30 | 30 | | adjudication hearing procedure under which a civil fine may be |
---|
31 | 31 | | imposed. |

32 | 32 | | SECTION 2. This Act takes effect September 1, 2017. |
