55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a revision of the essential knowledge and skills of the
88 public school foundation curriculum and proclamations for the
99 production of instructional materials.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1212 amended by adding Section 28.0025 to read as follows:
1313 Sec. 28.0025. REVIEW AND REVISION OF ESSENTIAL KNOWLEDGE
1414 AND SKILLS. (a) The State Board of Education shall:
1515 (1) conduct a review of the essential knowledge and
1616 skills for the foundation curriculum adopted under Section
1717 28.002(a)(1); and
1818 (2) revise the essential knowledge and skills for that
1919 curriculum to narrow the number and scope of student expectations
2020 for each subject and grade level in accordance with this section.
2121 (b) The scope of the essential knowledge and skills for each
2222 subject and grade level of the foundation curriculum must:
2323 (1) be more narrow than the scope of the essential
2424 knowledge and skills adopted as of January 1, 2017; and
2525 (2) require less time for a demonstration of mastery
2626 than required for the essential knowledge and skills adopted as of
2727 January 1, 2017.
2828 (c) In complying with this section, the State Board of
2929 Education shall:
3030 (1) ensure that a revision of the essential knowledge
3131 and skills for the foundation curriculum does not result in a need
3232 for the adoption of new instructional materials;
3333 (2) consider for each subject and grade level, the
3434 time:
3535 (A) a teacher would require to provide
3636 comprehensive instruction on a particular student expectation; and
3737 (B) a typical student would require to master a
3838 particular student expectation;
3939 (3) determine whether, in light of the consideration
4040 required by Subdivision (2), each essential knowledge and skill of
4141 a subject can be comprehensively taught within the instruction time
4242 required under Section 25.081, not including the amount of time
4343 required for testing;
4444 (4) determine whether the college and career readiness
4545 standards have been appropriately integrated in the essential
4646 knowledge and skills for each subject and grade level; and
4747 (5) consider whether an assessment instrument
4848 administered under Section 39.023 adequately assesses a particular
4949 student expectation.
5050 (d) Not later than September 1, 2020, the State Board of
5151 Education shall complete the review and revision of the essential
5252 knowledge and skills for each subject and grade level of the
5353 foundation curriculum that was last revised before September 1,
5454 2014.
5555 (e) This section expires September 1, 2021.
5656 SECTION 2. Section 31.002, Education Code, is amended by
5757 adding Subdivision (1-b) to read as follows:
5858 (1-b) "Proclamation" means a request for production of
5959 instructional materials issued by the State Board of Education.
6060 SECTION 3. Section 31.022, Education Code, is amended by
6161 adding Subsections (b-1), (b-2), and (b-3) and amending Subsection
6262 (f) to read as follows:
6363 (b-1) For any state fiscal biennium, the board may only
6464 issue proclamations for instructional materials in which the total
6565 projected cost of instructional materials under the proclamations
6666 does not exceed 75 percent of the total amount used to fund the
6767 instructional materials allotment under Section 31.0211 for that
6868 biennium.
6969 (b-2) Following the adoption of revised essential knowledge
7070 and skills for any subject, the board shall determine whether
7171 issuance of a proclamation is necessary based on the significance
7272 of the changes to the essential knowledge and skills. If the board
7373 determines a proclamation is necessary, the board shall issue:
7474 (1) a full call for instructional materials aligned to
7575 all of the essential knowledge and skills for the subject and grade
7676 level;
7777 (2) a supplemental call for instructional materials
7878 aligned to new or expanded essential knowledge and skills for the
7979 subject and grade level;
8080 (3) a call for new information demonstrating alignment
8181 of current instructional materials to the revised essential
8282 knowledge and skills; or
8383 (4) any combination of the calls described by
8484 Subdivisions (1), (2), and (3).
8585 (b-3) In determining the disbursement of money to the
8686 available school fund and the amount of that disbursement that will
8787 be used, in accordance with Section 43.001(d), to fund the
8888 instructional materials allotment under Section 31.0211, the board
8989 must consider the cost of all instructional materials and
9090 technology requirements for that state fiscal biennium.
9191 (f) The board shall amend any proclamation [request for
9292 production] issued for the purchase of instructional materials to
9393 conform to the instructional materials funding levels provided by
9494 the General Appropriations Act for the year of implementation and
9595 to comply with Subsection (b-1).
9696 SECTION 4. Sections 31.101(d) and (e), Education Code, are
9797 repealed.
9898 SECTION 5. This Act takes effect September 1, 2017.
