5	4		A BILL TO BE ENTITLED
6	5		AN ACT
7	6		relating to the entitlement of spouses of certain veterans with
8	7		disabilities to a veteran's employment preference.
9	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	9		SECTION 1. Section 657.002, Government Code, is amended to
11	10		read as follows:
12	11		Sec. 657.002. INDIVIDUALS QUALIFIED FOR VETERAN'S
13	12		EMPLOYMENT PREFERENCE. The following individuals qualify for a
14	13		veteran's employment preference:
15	14		(1) a veteran, including a veteran with a disability;
16	15		(2) a veteran's surviving spouse who has not
17	16		remarried; [and]
18	17		(3) an orphan of a veteran if the veteran was killed
19	18		while on active duty; and
20	19		(4) the spouse of a veteran with a disability who has a
21	20		total disability rating based either on having a service-connected
22	21		disability with a disability rating of 100 percent or on individual
23		-	unemployability.
	22	+	unemployability and who is receiving Supplemental Security Income
	23	+	(SSI) benefits under 42 U.S.C. Section 1381 et seq. or Social
	24	+	Security Disability Insurance (SSDI) benefits under 42 U.S.C.
	25	+	Section 401 et seq., if the spouse was married to the veteran at the
	26	+	time the veteran separated from the armed services.
24	27		SECTION 2. Section 657.003(b), Government Code, is amended
25	28		to read as follows:
26	29		(b) A state agency shall provide to an individual entitled
27	30		to a veteran's employment preference for employment or appointment
28	31		over other applicants for the same position who do not have a
29	32		greater qualification a veteran's employment preference, in the
30	33		following order of priority:
31	34		(1) a veteran with a disability;
32	35		(2) a veteran;
33	36		(3) a spouse of a veteran with a disability as
34	37		described by Section 657.002(4);
35	38		(4) a veteran's surviving spouse who has not
36	39		remarried; and
37	40		(5) [(4)] an orphan of a veteran if the veteran was
38	41		killed while on active duty.
39	42		SECTION 3. Section 657.005(b), Government Code, is amended
40	43		to read as follows:
41	44		(b) An applicant who is either a veteran with a disability
42	45		or a spouse of a veteran with a disability as described by Section
43	46		657.002(4) shall furnish the official records to the individual
44	47		whose duty is to fill the position.
45	48		SECTION 4. The changes in law made by this Act apply only to
46	49		an open position with a state agency for which the state agency
47	50		begins accepting applications on or after the effective date of
48	51		this Act. An open position with a state agency for which the state
49	52		agency begins accepting applications before the effective date of
50	53		this Act is governed by the law in effect on the date the state
51	54		agency began accepting applications, and the former law is
52	55		continued in effect for that purpose.
53	56		SECTION 5. This Act takes effect September 1, 2017.
