54 A BILL TO BE ENTITLED
65 AN ACT
76 relating to the entitlement of spouses of certain veterans with
87 disabilities to a veteran's employment preference.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 657.002, Government Code, is amended to
1110 read as follows:
1211 Sec. 657.002. INDIVIDUALS QUALIFIED FOR VETERAN'S
1312 EMPLOYMENT PREFERENCE. The following individuals qualify for a
1413 veteran's employment preference:
1514 (1) a veteran, including a veteran with a disability;
1615 (2) a veteran's surviving spouse who has not
1716 remarried; [and]
1817 (3) an orphan of a veteran if the veteran was killed
1918 while on active duty; and
2019 (4) the spouse of a veteran with a disability who has a
2120 total disability rating based either on having a service-connected
2221 disability with a disability rating of 100 percent or on individual
23- unemployability.
22+ unemployability and who is receiving Supplemental Security Income
23+ (SSI) benefits under 42 U.S.C. Section 1381 et seq. or Social
24+ Security Disability Insurance (SSDI) benefits under 42 U.S.C.
25+ Section 401 et seq., if the spouse was married to the veteran at the
26+ time the veteran separated from the armed services.
2427 SECTION 2. Section 657.003(b), Government Code, is amended
2528 to read as follows:
2629 (b) A state agency shall provide to an individual entitled
2730 to a veteran's employment preference for employment or appointment
2831 over other applicants for the same position who do not have a
2932 greater qualification a veteran's employment preference, in the
3033 following order of priority:
3134 (1) a veteran with a disability;
3235 (2) a veteran;
3336 (3) a spouse of a veteran with a disability as
3437 described by Section 657.002(4);
3538 (4) a veteran's surviving spouse who has not
3639 remarried; and
3740 (5) [(4)] an orphan of a veteran if the veteran was
3841 killed while on active duty.
3942 SECTION 3. Section 657.005(b), Government Code, is amended
4043 to read as follows:
4144 (b) An applicant who is either a veteran with a disability
4245 or a spouse of a veteran with a disability as described by Section
4346 657.002(4) shall furnish the official records to the individual
4447 whose duty is to fill the position.
4548 SECTION 4. The changes in law made by this Act apply only to
4649 an open position with a state agency for which the state agency
4750 begins accepting applications on or after the effective date of
4851 this Act. An open position with a state agency for which the state
4952 agency begins accepting applications before the effective date of
5053 this Act is governed by the law in effect on the date the state
5154 agency began accepting applications, and the former law is
5255 continued in effect for that purpose.
5356 SECTION 5. This Act takes effect September 1, 2017.
