125 AN ACT
136 relating to the powers and duties of the commissioner of education
147 regarding granting additional charters for open-enrollment charter
158 schools.
169 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1710 SECTION 1. Subchapter D, Chapter 12, Education Code, is
1811 amended by adding Section 12.1015 to read as follows:
1912 Sec. 12.1015. ADDITIONAL CHARTER FOR OPEN-ENROLLMENT
2013 CHARTER SCHOOLS ALLOWED. (a) Notwithstanding Section
2114 12.101(b-3), the commissioner may grant more than one charter for
2215 an open-enrollment charter school to a charter holder if the
2316 additional charter is for an open-enrollment charter school that
2417 has a distinct purpose or student population.
2518 (b) The commissioner by rule shall identify various types of
2619 open-enrollment charter schools to be used to determine if an
2720 open-enrollment charter school has a distinct purpose or will serve
2821 a different student population for purposes of this section. The
2922 commissioner may award a charter under Subsection (a) if the
3023 commissioner determines the charter will serve a distinct purpose
3124 or student population regardless of whether the type of school for
3225 which the charter is sought has been identified by the
3326 commissioner.
3427 (c) The rules adopted under Subsection (b) must account for
3528 the following types of open-enrollment charter schools:
3629 (1) an open-enrollment charter school that serves a
3730 general student population through a distinctly different
3831 educational model;
3932 (2) an alternative education open-enrollment charter
4033 school that serves students who:
4134 (A) have dropped out of school; or
4235 (B) are students at risk of dropping out of
4336 school, as defined by Section 29.081;
4437 (3) an open-enrollment charter school operating under
4538 a charter granted under Section 12.1014;
46- (4) a virtual open-enrollment charter school; and
39+ (4) a virtual open-enrollment charter school;
4740 (5) any other open-enrollment charter school that
4841 serves a distinct student population, as determined by commissioner
49- rule.
42+ rule; and
43+ (6) an open-enrollment charter school that has assumed
44+ the operations of another charter holder's open-enrollment charter
45+ school or school district campus and is implementing a campus
46+ turnaround plan approved by the commissioner under Chapter 39.
47+ (d) Notwithstanding Subsection (c)(6), the transfer of an
48+ existing charter school to a charter holder authorized under this
49+ section does not affect the performance rating assigned for the
50+ current school year or previous school years or any intervention or
51+ sanction actions determined by the commissioner under this
52+ subchapter or Chapter 39.
5053 SECTION 2. This Act applies beginning with the 2017-2018
5154 school year.
5255 SECTION 3. This Act takes effect only if a specific
5356 appropriation for the implementation of the Act is provided in a
5457 general appropriations act of the 85th Legislature.
5558 SECTION 4. This Act takes effect immediately if it receives
5659 a vote of two-thirds of all the members elected to each house, as
5760 provided by Section 39, Article III, Texas Constitution. If this
5861 Act does not receive the vote necessary for immediate effect, this
5962 Act takes effect September 1, 2017.
