| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter E-1, Chapter 411, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 411.0746 to read as follows: |
|---|
| 13 | 13 | | Sec. 411.0746. RETURN OF FEES. A court that issues an order |
|---|
| 14 | 14 | | of nondisclosure of criminal history record information under this |
|---|
| 15 | 15 | | subchapter may order that any fee, or portion of a fee, required to |
|---|
| 16 | 16 | | be paid under this subchapter or other law in relation to the order |
|---|
| 17 | 17 | | be returned to the person who is the subject of that order. |
|---|
| 18 | 18 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 19 | 19 | | an order of nondisclosure of criminal history record information |
|---|
| 20 | 20 | | issued on or after the effective date of this Act. The issuance of |
|---|
| 21 | 21 | | an order of nondisclosure of criminal history record information |
|---|
| 22 | 22 | | before the effective date of this Act is governed by the law in |
|---|
| 23 | 23 | | effect on the date the order was issued, and the former law is |
|---|
| 24 | 24 | | continued in effect for that purpose. |

| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2017. |
