99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to broker agreements for the leasing of real property
1212 owned by a county.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Sections 263.008(b), (c), (d), and (e), Local
1515 Government Code, are amended to read as follows:
1616 (b) The commissioners court of a county may contract with a
1717 broker to sell or lease a tract of real property that is owned by the
1818 county.
1919 (c) The commissioners court of a county may pay a fee if a
2020 broker produces a ready, willing, and able buyer or lessee to
2121 purchase or lease a tract of real property.
2222 (d) If a contract made under Subsection (b) requires a
2323 broker to list the tract of real property for sale or lease for at
2424 least 30 days with a multiple-listing service used by other brokers
2525 in the county, the commissioners court on or after the 30th day
2626 after the date the property is listed may sell or lease the tract of
2727 real property to a ready, willing, and able buyer or lessee who is
2828 produced by any broker using the multiple-listing service and who
2929 submits the highest cash offer.
3030 (e) The commissioners court may sell or lease a tract of
3131 real property under this section without complying with the
3232 requirements for conducting a public auction, including the
3333 requirements prescribed by Section 263.001.
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2017.
