13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Sections 263.008(b), (c), (d), and (e), Local |
---|
15 | 15 | | Government Code, are amended to read as follows: |
---|
16 | 16 | | (b) The commissioners court of a county may contract with a |
---|
17 | 17 | | broker to sell or lease a tract of real property that is owned by the |
---|
18 | 18 | | county. |
---|
19 | 19 | | (c) The commissioners court of a county may pay a fee if a |
---|
20 | 20 | | broker produces a ready, willing, and able buyer or lessee to |
---|
21 | 21 | | purchase or lease a tract of real property. |
---|
22 | 22 | | (d) If a contract made under Subsection (b) requires a |
---|
23 | 23 | | broker to list the tract of real property for sale or lease for at |
---|
24 | 24 | | least 30 days with a multiple-listing service used by other brokers |
---|
25 | 25 | | in the county, the commissioners court on or after the 30th day |
---|
26 | 26 | | after the date the property is listed may sell or lease the tract of |
---|
27 | 27 | | real property to a ready, willing, and able buyer or lessee who is |
---|
28 | 28 | | produced by any broker using the multiple-listing service and who |
---|
29 | 29 | | submits the highest cash offer. |
---|
30 | 30 | | (e) The commissioners court may sell or lease a tract of |
---|
31 | 31 | | real property under this section without complying with the |
---|
32 | 32 | | requirements for conducting a public auction, including the |
---|
33 | 33 | | requirements prescribed by Section 263.001. |
---|
34 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
---|
35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
---|
36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
---|
38 | 38 | | Act takes effect September 1, 2017. |
