125 AN ACT
136 relating to audits of a regional mobility authority by the state
147 auditor.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Subchapter G, Chapter 370, Transportation Code,
1710 is amended by adding Section 370.318 to read as follows:
1811 Sec. 370.318. AUDIT REQUIREMENT FOR DEPARTMENT GRANT OR
1912 LOAN. The department may not make a grant or loan to an authority
2013 for a transportation project unless the authority agrees in writing
2114 to allow state audits of the authority at any time until the
2215 completion of the transportation project for which the funds are
2316 granted or loaned at the discretion of the legislative audit
2417 committee established under Section 321.002, Government Code.
2518 SECTION 2. Chapter 321, Government Code, is amended by
2619 adding Section 321.024 to read as follows:
2720 Sec. 321.024. REGIONAL MOBILITY AUTHORITIES SUBJECT TO
2821 AUDIT. A regional mobility authority under Chapter 370,
2922 Transportation Code, is subject to audit under this chapter as if
3023 the authority were a department.
3124 SECTION 3. Section 370.318, Transportation Code, as added
3225 by this Act, applies only to a grant or loan agreement that is
3326 entered into on or after the effective date of this Act. A grant or
3427 loan agreement that is entered into before the effective date of
3528 this Act is governed by the law in effect on the date the agreement
3629 was entered into, and the former law is continued in effect for that
3730 purpose.
3831 SECTION 4. This Act takes effect September 1, 2017.
