| 15 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 9 | | SECTION 1. Subchapter G, Chapter 370, Transportation Code, |
|---|
| 17 | 10 | | is amended by adding Section 370.318 to read as follows: |
|---|
| 18 | 11 | | Sec. 370.318. AUDIT REQUIREMENT FOR DEPARTMENT GRANT OR |
|---|
| 19 | 12 | | LOAN. The department may not make a grant or loan to an authority |
|---|
| 20 | 13 | | for a transportation project unless the authority agrees in writing |
|---|
| 21 | 14 | | to allow state audits of the authority at any time until the |
|---|
| 22 | 15 | | completion of the transportation project for which the funds are |
|---|
| 23 | 16 | | granted or loaned at the discretion of the legislative audit |
|---|
| 24 | 17 | | committee established under Section 321.002, Government Code. |

| 25 | 18 | | SECTION 2. Chapter 321, Government Code, is amended by |
|---|
| 26 | 19 | | adding Section 321.024 to read as follows: |
|---|
| 27 | 20 | | Sec. 321.024. REGIONAL MOBILITY AUTHORITIES SUBJECT TO |
|---|
| 28 | 21 | | AUDIT. A regional mobility authority under Chapter 370, |
|---|
| 29 | 22 | | Transportation Code, is subject to audit under this chapter as if |
|---|
| 30 | 23 | | the authority were a department. |
|---|
| 31 | 24 | | SECTION 3. Section 370.318, Transportation Code, as added |
|---|
| 32 | 25 | | by this Act, applies only to a grant or loan agreement that is |
|---|
| 33 | 26 | | entered into on or after the effective date of this Act. A grant or |
|---|
| 34 | 27 | | loan agreement that is entered into before the effective date of |
|---|
| 35 | 28 | | this Act is governed by the law in effect on the date the agreement |
|---|
| 36 | 29 | | was entered into, and the former law is continued in effect for that |
|---|
| 37 | 30 | | purpose. |
|---|
| 38 | 31 | | SECTION 4. This Act takes effect September 1, 2017. |
