12 | 7 | | Texas System to the Parks and Wildlife Department. |

13 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
14 | 9 | | SECTION 1. (a) Not later than December 31, 2017, the board |
---|
15 | 10 | | of regents of The University of Texas System shall transfer to the |
---|
16 | 11 | | Parks and Wildlife Department the real property described by |
---|
17 | 12 | | Section 2 of this Act. |
---|
18 | 13 | | (b) The consideration for the transfer authorized by |
---|
19 | 14 | | Subsection (a) of this section is the requirement that the Parks and |
---|
20 | 15 | | Wildlife Department use the property transferred only for a public |
---|
21 | 16 | | golf course, a purpose that benefits the public interest of the |
---|
22 | 17 | | state. If the Parks and Wildlife Department no longer uses the |
---|
23 | 18 | | property for a public golf course, ownership of the property |
---|
24 | 19 | | automatically reverts to The University of Texas System. |
---|
25 | 20 | | (c) The board of regents of The University of Texas System |
---|
26 | 21 | | shall transfer the property by an appropriate instrument of |
---|
27 | 22 | | transfer that: |
---|
28 | 23 | | (1) includes a provision that: |
---|
29 | 24 | | (A) requires the Parks and Wildlife Department to |
---|
30 | 25 | | use the property for a public golf course, a purpose that benefits |
---|
31 | 26 | | the public interest of the state; and |
---|
32 | 27 | | (B) indicates that ownership of the property |
---|
33 | 28 | | automatically reverts to The University of Texas System if the |
---|
34 | 29 | | Parks and Wildlife Department no longer uses the property for a |
---|
35 | 30 | | public golf course; and |
---|
36 | 31 | | (2) describes the property to be transferred by metes |
---|
37 | 32 | | and bounds. |
---|
38 | 33 | | (d) All contracts, leases, and other obligations governing |
---|
39 | 34 | | the real property described by Section 2 of this Act in effect on |
---|
40 | 35 | | the effective date of this Act are transferred to the Parks and |
---|
41 | 36 | | Wildlife Department. |
---|
42 | 37 | | (e) Sections 31.158 and 31.159, Natural Resources Code, do |
---|
43 | 38 | | not apply to the transfer of real property authorized by this Act. |
---|
44 | 39 | | SECTION 2. The real property to which Section 1 of this Act |

130 | 125 | | Act does not receive the vote necessary for immediate effect, this |
---|
131 | 126 | | Act takes effect September 1, 2017. |
