1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to liability of certain electric utilities that allow
1414 certain uses of land that the electric utility owns, occupies, or
1515 leases.
1616 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1717 SECTION 1. Section 75.007(e), Civil Practice and Remedies
1818 Code, is amended to read as follows:
1919 (e) This section does not affect Section 75.001, 75.002,
2020 [75.0021,] 75.003, or 75.004 or create or increase the liability of
2121 any person.
2222 SECTION 2. Sections 75.0021 and 75.0022(b), Civil Practice
2323 and Remedies Code, are repealed.
2424 SECTION 3. The change in law made by this Act applies only
2525 to a cause of action that accrues on or after the effective date of
2626 this Act. A cause of action that accrues before the effective date
2727 of this Act is governed by the law applicable to the cause of action
2828 immediately before that date, and that law is continued in effect
2929 for that purpose.
3030 SECTION 4. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2017.
