No. 949 (Schofield) A BILL TO BE ENTITLED AN ACT relating to a limitation on the amount of attorney's fees awarded in a case assigned to a special three-judge district court. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 22A, Government Code, is amended by adding Section 22A.0055 to read as follows: Sec. 22A.0055. ATTORNEY'S FEES. In a case assigned to a special three-judge district court under this chapter and in any related case consolidated with the case before the court, the court may not award attorney's fees in an amount that exceeds $250,000. SECTION 2. Section 22A.0055, Government Code, as added by this Act, applies only to a case assigned to a special three-judge district court on or after the effective date of this Act. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2017.
