105 AN ACT
116 relating to the regulation of raw milk and raw milk products; adding
127 a provision subject to a criminal penalty.
138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. Subchapter A, Chapter 435, Health and Safety
1510 Code, is amended by adding Sections 435.0061, 435.0062, and
1611 435.0063 to read as follows:
1712 Sec. 435.0061. RAW MILK AND RAW MILK PRODUCTS FOR RETAIL
1813 SALE. (a) This section does not authorize the sale of:
1914 (1) raw milk or raw milk products to or on the premises
2015 of a grocery store, supermarket, or similar retail market;
2116 (2) raw milk or raw milk products that are a blend of
2217 raw milk purchased from more than one holder of a permit issued
2318 under this chapter; or
2419 (3) raw milk or raw milk products by a person other
2520 than the permit holder.
2621 (b) Except as provided by Section 435.013, a permit holder
2722 who is authorized to sell raw milk or raw milk products at retail
2823 may make retail sales of raw milk or raw milk products directly to a
2924 consumer in this state at:
3025 (1) the permit holder's place of business;
3126 (2) the consumer's residence; or
3227 (3) a farmers' market as defined by Section 437.020.
3328 (c) Raw milk and raw milk products must be maintained in
3429 compliance with Section 435.0063.
3530 (d) A person who sells raw milk or raw milk products under
3631 this section shall affix to individual raw milk or raw milk product
3732 containers a label that includes:
3833 (1) the name of the permit holder;
3934 (2) the permit holder's permit number;
4035 (3) the calendar date the raw milk or raw milk product
4136 was placed in the container; and
4237 (4) the following statement: "This product contains
4338 unpasteurized milk. Consuming raw foods, including raw dairy
4439 products, may increase your risk of food-borne illness. Persons at
4540 higher risk for food-borne illness include pregnant and nursing
4641 women, children, the elderly, and people with weakened immune
4742 systems."
4843 Sec. 435.0062. AVAILABILITY OF RECORDS ON RAW MILK TESTING.
4944 On request, the department shall provide the requestor with a
5045 record of test results from an inspection of raw milk or raw milk
5146 products conducted under Section 435.004 or 435.005.
5247 Sec. 435.0063. STORING, HANDLING, AND TRANSPORTING RAW MILK
5348 AND RAW MILK PRODUCTS FOR RETAIL SALE. (a) The executive
5449 commissioner shall adopt rules for the safe storing, handling, and
5550 transporting of raw milk and raw milk products produced for sale
5651 under Section 435.0061.
5752 (b) Raw milk and raw milk products produced for retail sale
5853 under this chapter must be placed in a sterile or single-use
5954 container and sold not later than the fifth day after the date the
6055 container was filled.
6156 (c) Raw milk and raw milk products being transported for
6257 delivery must be:
6358 (1) maintained in air temperatures at or below 45
6459 degrees Fahrenheit at all times except during transfer from one
6560 storage area or transportation vehicle to another; and
6661 (2) protected from exposure to direct sunlight.
6762 (d) The department or a local health authority may not
6863 mandate the specific method for complying with a temperature
6964 requirement.
7065 (e) A producer may contract with another person to transport
7166 and deliver raw milk and raw milk products in accordance with this
7267 section. The producer is jointly and severally liable for
7368 transport and delivery of raw milk and raw milk products not
7469 conducted in accordance with this chapter and department rules.
7570 SECTION 2. This Act takes effect September 1, 2017.
