| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 123.006, Human Resources Code, is | |
| 11 | 11 | amended by adding Subsection (c) to read as follows: | |
| 12 | 12 | (c) The limitation on the number of persons who may reside | |
| 13 | 13 | in a community home at the same time imposed by this section does | |
| 14 | 14 | not apply to an assisted living facility licensed under Chapter | |
| 15 | 15 | 247, Health and Safety Code, unless the assisted living facility | |
| 16 | 16 | qualifies as a community home in accordance with Section 123.004. | |
| 17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
| 18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
| 19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
| 20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
| 21 | 21 | Act takes effect September 1, 2019. |
