A BILL TO BE ENTITLED
AN ACT
relating to the number of persons authorized to reside in certain
homes and facilities for persons with disabilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 123.006, Human Resources Code, is
amended by adding Subsection (c) to read as follows:
(c) The limitation on the number of persons who may reside
in a community home at the same time imposed by this section does
not apply to an assisted living facility licensed under Chapter
247, Health and Safety Code, unless the assisted living facility
qualifies as a community home in accordance with Section 123.004.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2019.
