7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Section 61.9832, Education Code, is amended by |
---|
9 | 11 | | amending Subsections (a) and (c) and adding Subsection (c-1) to |
---|
10 | 12 | | read as follows: |
---|
11 | 13 | | (a) To be eligible to receive loan repayment assistance |
---|
12 | 14 | | under this subchapter, a person must: |
---|
13 | 15 | | (1) apply annually for the loan repayment assistance |
---|
14 | 16 | | in the manner prescribed by the board; |
---|
15 | 17 | | (2) be a United States citizen; |
---|
16 | 18 | | (3) have completed an undergraduate or graduate |
---|
17 | 19 | | program in mathematics or science; |
---|
18 | 20 | | (4) have a cumulative grade point average of at least |
---|
19 | 21 | | 3.0 [3.5] on a four-point scale or the equivalent; |
---|
20 | 22 | | (5) be: |
---|
21 | 23 | | (A) certified under Subchapter B, Chapter 21, to |
---|
22 | 24 | | teach mathematics or science in a public school in this state; or |
---|
23 | 25 | | (B) teaching under a probationary teaching |
---|
24 | 26 | | certificate; |
---|
25 | 27 | | (6) have been employed for at least one year as a |
---|
26 | 28 | | teacher teaching mathematics or science at a public school that |
---|
27 | 29 | | receives funding under Title I, Elementary and Secondary Education |
---|
28 | 30 | | Act of 1965 (20 U.S.C. Section 6301 et seq.); |
---|
29 | 31 | | (7) not be in default on any other education loan; |
---|
30 | 32 | | (8) not receive any other state or federal loan |
---|
31 | 33 | | repayment assistance, including a Teacher Education Assistance for |
---|
32 | 34 | | College and Higher Education (TEACH) Grant or teacher loan |
---|
33 | 35 | | forgiveness; |
---|
34 | 36 | | (9) enter into an agreement with the board under |
---|
35 | 37 | | Subsection (c); and |
---|
36 | 38 | | (10) comply with any other requirement adopted by the |
---|
37 | 39 | | board under this subchapter. |
---|
38 | 40 | | (c) To receive loan repayment assistance under this |
---|
39 | 41 | | subchapter, a person must enter into an agreement with the board |
---|
40 | 42 | | that includes the following provisions: |
---|
41 | 43 | | (1) the person will accept an offer of full-time |
---|
42 | 44 | | employment to teach mathematics or science, as applicable based on |
---|
43 | 45 | | the person's certification, in a public school that receives |
---|
44 | 46 | | funding under Title I, Elementary and Secondary Education Act of |
---|
45 | 47 | | 1965 (20 U.S.C. Section 6301 et seq.); |
---|
46 | 48 | | (2) the person will complete four consecutive years of |
---|
47 | 49 | | employment as a full-time classroom teacher in a school described |
---|
48 | 50 | | by Subdivision (1) whose primary duty is to teach mathematics or |
---|
49 | 51 | | science, as applicable, based on the person's certification; |
---|
50 | 52 | | (3) beginning with the school year immediately |
---|
51 | 53 | | following the last of the four consecutive school years described |
---|
52 | 54 | | by Subdivision (2), the person will complete an [four] additional |
---|
53 | 55 | | number of consecutive school years teaching in any public school in |
---|
54 | 56 | | this state, as prescribed by board rule; and |
---|
55 | 57 | | (4) the person acknowledges the conditional nature of |
---|
56 | 58 | | the loan repayment assistance. |
---|
57 | 59 | | (c-1) The rules adopted under Subsection (c)(3) may not |
---|
58 | 60 | | require a person to complete more than four additional consecutive |
---|
59 | 61 | | school years of teaching as described by that subdivision. |
---|
60 | | - | SECTION 2. Section 61.9835(a), Education Code, is amended |
---|
61 | | - | to read as follows: |
---|
62 | | - | (a) The board may provide repayment assistance under this |
---|
63 | | - | subchapter for the repayment of any student loan that: |
---|
64 | | - | (1) is for education at: |
---|
65 | | - | (A) a public or private institution of higher |
---|
66 | | - | education; or |
---|
67 | | - | (B) a nonprofit, tax-exempt, regionally |
---|
68 | | - | accredited college or university operating in accordance with a |
---|
69 | | - | memorandum of understanding with this state under an executive |
---|
70 | | - | order issued by the governor; and |
---|
71 | | - | (2) is received by an eligible person through an |
---|
72 | | - | eligible lender. |
---|
73 | | - | SECTION 3. (a) As soon as practicable after the effective |
---|

80 | 69 | | effective date of this Act. A loan repayment assistance agreement |
---|
81 | 70 | | entered into before the effective date of this Act is governed by |
---|
82 | 71 | | the law in effect immediately before that date, and the former law |
---|
83 | 72 | | is continued in effect for that purpose. |
---|
84 | | - | SECTION 4. This Act takes effect September 1, 2019. |
