46 AN ACT
57 relating to student loan repayment assistance under the math and
68 science scholars loan repayment program.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 61.9832, Education Code, is amended by
911 amending Subsections (a) and (c) and adding Subsection (c-1) to
1012 read as follows:
1113 (a) To be eligible to receive loan repayment assistance
1214 under this subchapter, a person must:
1315 (1) apply annually for the loan repayment assistance
1416 in the manner prescribed by the board;
1517 (2) be a United States citizen;
1618 (3) have completed an undergraduate or graduate
1719 program in mathematics or science;
1820 (4) have a cumulative grade point average of at least
1921 3.0 [3.5] on a four-point scale or the equivalent;
2022 (5) be:
2123 (A) certified under Subchapter B, Chapter 21, to
2224 teach mathematics or science in a public school in this state; or
2325 (B) teaching under a probationary teaching
2426 certificate;
2527 (6) have been employed for at least one year as a
2628 teacher teaching mathematics or science at a public school that
2729 receives funding under Title I, Elementary and Secondary Education
2830 Act of 1965 (20 U.S.C. Section 6301 et seq.);
2931 (7) not be in default on any other education loan;
3032 (8) not receive any other state or federal loan
3133 repayment assistance, including a Teacher Education Assistance for
3234 College and Higher Education (TEACH) Grant or teacher loan
3335 forgiveness;
3436 (9) enter into an agreement with the board under
3537 Subsection (c); and
3638 (10) comply with any other requirement adopted by the
3739 board under this subchapter.
3840 (c) To receive loan repayment assistance under this
3941 subchapter, a person must enter into an agreement with the board
4042 that includes the following provisions:
4143 (1) the person will accept an offer of full-time
4244 employment to teach mathematics or science, as applicable based on
4345 the person's certification, in a public school that receives
4446 funding under Title I, Elementary and Secondary Education Act of
4547 1965 (20 U.S.C. Section 6301 et seq.);
4648 (2) the person will complete four consecutive years of
4749 employment as a full-time classroom teacher in a school described
4850 by Subdivision (1) whose primary duty is to teach mathematics or
4951 science, as applicable, based on the person's certification;
5052 (3) beginning with the school year immediately
5153 following the last of the four consecutive school years described
5254 by Subdivision (2), the person will complete an [four] additional
5355 number of consecutive school years teaching in any public school in
5456 this state, as prescribed by board rule; and
5557 (4) the person acknowledges the conditional nature of
5658 the loan repayment assistance.
5759 (c-1) The rules adopted under Subsection (c)(3) may not
5860 require a person to complete more than four additional consecutive
5961 school years of teaching as described by that subdivision.
60- SECTION 2. Section 61.9835(a), Education Code, is amended
61- to read as follows:
62- (a) The board may provide repayment assistance under this
63- subchapter for the repayment of any student loan that:
64- (1) is for education at:
65- (A) a public or private institution of higher
66- education; or
67- (B) a nonprofit, tax-exempt, regionally
68- accredited college or university operating in accordance with a
69- memorandum of understanding with this state under an executive
70- order issued by the governor; and
71- (2) is received by an eligible person through an
72- eligible lender.
73- SECTION 3. (a) As soon as practicable after the effective

7463 date of this Act, the Texas Higher Education Coordinating Board
7564 shall adopt rules necessary to administer Section 61.9832,
7665 Education Code, as amended by this Act.
7766 (b) Section 61.9832, Education Code, as amended by this Act,
7867 applies only to a loan repayment assistance agreement entered into
7968 under Subchapter KK, Chapter 61, Education Code, on or after the
8069 effective date of this Act. A loan repayment assistance agreement
8170 entered into before the effective date of this Act is governed by
8271 the law in effect immediately before that date, and the former law
8372 is continued in effect for that purpose.
84- SECTION 4. This Act takes effect September 1, 2019.
