| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 12.104, Education Code, is amended by |
|---|
| 10 | 12 | | adding Subsections (a-1) and (a-2) to read as follows: |
|---|
| 11 | 13 | | (a-1) The governing body of an open-enrollment charter |
|---|
| 12 | 14 | | school may: |
|---|
| 13 | 15 | | (1) employ security personnel and commission peace |
|---|
| 14 | 16 | | officers in the same manner as a board of trustees of a school |
|---|
| 15 | 17 | | district under Section 37.081; and |
|---|
| 16 | 18 | | (2) enter into a memorandum of understanding with a |
|---|
| 17 | 19 | | local law enforcement agency to assign a school resource officer, |
|---|
| 18 | 20 | | as that term is defined by Section 1701.601, Occupations Code, to |
|---|
| 19 | 21 | | the school. |
|---|
| 20 | 22 | | (a-2) A reference in law to a peace officer commissioned |
|---|
| 21 | 23 | | under Section 37.081 includes a peace officer commissioned by an |
|---|
| 22 | 24 | | open-enrollment charter school in accordance with Subsection |
|---|
| 23 | 25 | | (a-1), and a charter school peace officer has the same powers, |
|---|
| 24 | 26 | | duties, and immunities as a peace officer commissioned under that |
|---|
| 25 | 27 | | section. |
|---|
| 26 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 32 | | Act takes effect September 1, 2019. |
