5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to a common characteristic or use project in a public
68 improvement district in certain municipalities.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 372.0035, Local Government Code, is
911 amended by amending Subsection (a) and adding Subsection (e) to
1012 read as follows:
1113 (a) This section applies only to:
1214 (1) a municipality that:
1315 (A) has a population of more than 650,000 and
1416 less than two million; [or]
1517 (B) has a population of more than 325,000 and
1618 less than 625,000; or
1719 (C) has a population of more than 115,000 and
1820 borders Lake Lewisville; and
1921 (2) a public improvement district established under
2022 this subchapter and solely composed of territory in which the only
2123 businesses are:
2224 (A) hotels with 100 or more rooms ordinarily used
2325 for sleeping, if the district is established by a municipality
2426 described by Subdivision (1)(A); or
2527 (B) hotels with 75 or more rooms ordinarily used
2628 for sleeping, if the district is established by a municipality
2729 described by Subdivision (1)(B) or (C).
2830 (e) A municipality described by Subsection (a)(1)(C) may
2931 undertake a project under this section only for a purpose described
3032 by Section 372.003(b)(13).
3133 SECTION 2. This Act takes effect September 1, 2019.
