711 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
812 ARTICLE 1. ENTITIES GIVEN 2021 SUNSET DATE
913 SECTION 1.01. TEACHER RETIREMENT SYSTEM OF TEXAS. Section
1014 825.006, Government Code, is amended to read as follows:
1115 Sec. 825.006. SUNSET PROVISION. The board of trustees of
1216 the Teacher Retirement System of Texas is subject to review under
1317 Chapter 325 (Texas Sunset Act), but is not abolished under that
1418 chapter. The board shall be reviewed during the period in which
1519 state agencies abolished in 2021 [2025], and every 12th year after
1620 that year, are reviewed.
1721 SECTION 1.02. ANATOMICAL BOARD OF THE STATE OF TEXAS.
1822 Subchapter A, Chapter 691, Health and Safety Code, is amended by
1923 adding Section 691.003 to read as follows:
2024 Sec. 691.003. SUNSET PROVISION. The Anatomical Board of
2125 the State of Texas is subject to Chapter 325, Government Code (Texas
2226 Sunset Act). Unless continued in existence as provided by that
2327 chapter, the board is abolished September 1, 2021.
2428 SECTION 1.03. TEXAS DEPARTMENT OF LICENSING AND REGULATION.
2529 Section 51.002, Occupations Code, is amended to read as follows:
2630 Sec. 51.002. APPLICATION OF SUNSET ACT. (a) The Texas
2731 Commission of Licensing and Regulation and the Texas Department of
2832 Licensing and Regulation are subject to Chapter 325, Government
2933 Code (Texas Sunset Act). Unless continued in existence as provided
3034 by that chapter, the commission and the department are abolished
3135 September 1, 2021.
3236 (b) The review of the commission and department by the
3337 Sunset Advisory Commission under this section may not include a
3438 review of any program that was transferred to the department on or
3539 after September 1, 2016.
3640 SECTION 1.04. TEXAS RACING COMMISSION. Section
3741 2021.008(a), Occupations Code, is amended to read as follows:
3842 (a) The commission is subject to Chapter 325, Government
3943 Code (Texas Sunset Act). Unless continued in existence as provided
4044 by that chapter, and except as provided by Subsections (b) and (c),
4145 the commission is abolished and this subtitle expires September 1,
4246 2021 [2023].
4347 ARTICLE 2. ENTITIES GIVEN 2023 SUNSET DATE
4448 SECTION 2.01. LIMITED REVIEW OF DEPARTMENT OF FAMILY AND
4549 PROTECTIVE SERVICES. Section 531.0206(a), Government Code, is
4650 amended to read as follows:
4751 (a) The Sunset Advisory Commission shall conduct a
4852 limited-scope review of the commission during the state fiscal
4953 biennium ending August 31, 2023, in the manner provided by Chapter
5054 325 (Texas Sunset Act). The review must provide:
5155 (1) an update on the commission's progress with
5256 respect to the consolidation of the health and human services
5357 system mandated by this subchapter, including the commission's
5458 compliance with the transition plan required under Section
5559 531.0204;
5660 (2) an evaluation and recommendations regarding the
5761 need to continue the Department of State Health Services as a state
5862 agency separate from the commission;
5963 (3) an evaluation and recommendations regarding the
6064 need to continue the Department of Family and Protective Services
6165 as a state agency separate from the commission; and
6266 (4) [(3)] any additional information the Sunset
6367 Advisory Commission determines appropriate, including information
6468 regarding any additional organizational changes the Sunset
6569 Advisory Commission recommends.
6670 SECTION 2.02. OFFICE OF INSPECTOR GENERAL, HEALTH AND HUMAN
6771 SERVICES COMMISSION. (a) Section 531.102, Government Code, is
6872 amended by adding Subsection (y) to read as follows:
6973 (y) The Sunset Advisory Commission shall conduct a
7074 special-purpose review of the overall performance of the
7175 commission's office of inspector general. In conducting the
7276 review, the Sunset Advisory Commission shall particularly focus on
7377 the office's investigations and the effectiveness and efficiency of
7478 the office's processes. The review shall be conducted during the
7579 period in which state agencies abolished in 2023 are reviewed. The
7680 office is not abolished solely because the office is not explicitly
7781 continued following the review required by this subsection. This
7882 subsection expires September 1, 2023.
7983 (b) Section 14, Chapter 945 (S.B. 207), Acts of the 84th
8084 Legislature, Regular Session, 2015, is repealed.
8185 SECTION 2.03. TEXAS INVASIVE SPECIES COORDINATING
8286 COMMITTEE. Section 776.007(a), Government Code, is amended to read
8387 as follows:
8488 (a) The committee is subject to Chapter 325 (Texas Sunset
8589 Act). Unless continued in existence as provided by that chapter,
8690 the committee is abolished and this chapter expires September 1,
8791 2023 [2021].
8892 SECTION 2.04. TEXAS JUVENILE JUSTICE BOARD AND TEXAS
8993 JUVENILE JUSTICE DEPARTMENT. Section 202.010, Human Resources
9094 Code, is amended to read as follows:
9195 Sec. 202.010. SUNSET PROVISION. The Texas Juvenile Justice
9296 Board and the Texas Juvenile Justice Department are subject to
9397 Chapter 325, Government Code (Texas Sunset Act). Unless continued
9498 in existence as provided by that chapter, the board and the
9599 department are abolished September 1, 2023 [2021].
96100 SECTION 2.05. DIVISION OF WORKERS' COMPENSATION, TEXAS
97101 DEPARTMENT OF INSURANCE. Section 31.004(b), Insurance Code, is
98102 amended to read as follows:
99103 (b) Unless continued as provided by Chapter 325, Government
100104 Code, the duties of the division of workers' compensation of the
101105 Texas Department of Insurance under Title 5, Labor Code, expire
102106 September 1, 2023 [2021], or another date designated by the
103107 legislature.
104108 SECTION 2.06. OFFICE OF INJURED EMPLOYEE COUNSEL. Section
105109 404.003, Labor Code, is amended to read as follows:
106110 Sec. 404.003. SUNSET PROVISION. The office of injured
107111 employee counsel is subject to Chapter 325, Government Code (Texas
108112 Sunset Act). Unless continued in existence as provided by that
109113 chapter, the office is abolished and this chapter expires September
110114 1, 2023 [2021].
111- SECTION 2.07. REVIEW OF PROGRAMS TRANSFERRED TO TEXAS
112- DEPARTMENT OF LICENSING AND REGULATION. Subchapter A, Chapter 51,
113- Occupations Code, is amended by adding Section 51.0021 to read as

115- Sec. 51.0021. SUNSET REVIEW OF TRANSFERRED PROGRAMS.
116- (a) Separate from the review of the commission and department
117- required under Section 51.002, the commission and department are
118- subject to a limited review under Chapter 325, Government Code
119- (Texas Sunset Act), of the programs transferred to the department
120- on or after September 1, 2016. The review shall be conducted during
121- the period in which state agencies abolished in 2023 are reviewed.
122- (b) This section expires September 1, 2023.

144136 Certification Commission is subject to Chapter 325 (Texas Sunset
145137 Act), but is not abolished under that chapter. The commission shall
146138 be reviewed during the period in which state agencies abolished in
147139 2025, [2023] and every 12th year after that year, [2023] are
148140 reviewed.
149141 SECTION 3.03. TEXAS BOARD OF CRIMINAL JUSTICE AND TEXAS

217209 Agency is subject to Chapter 325, Government Code (Texas Sunset
218210 Act). Unless continued in existence as provided by that chapter,
219211 the agency is abolished September 1, 2027 [2025].
220212 (b) As part of the Sunset Advisory Commission's review of
221213 the agency under Subsection (a), the commission in coordination
222214 with the agency shall select for review three regional education
223215 service centers that serve diverse geographic areas of the state
224216 and diverse population sizes. The commission's review of the
225217 agency must include an evaluation of the agency's oversight of the
226218 centers.
227219 SECTION 4.02. EXPANDED LEARNING OPPORTUNITIES COUNCIL.

295293 Sec. 865.0011. SUNSET REVIEW. The state board of the
296294 pension system is subject to review under Chapter 325 (Texas Sunset
297295 Act) but is not abolished under that chapter. The state board shall
298296 be reviewed during the period in which state agencies scheduled to
299297 be abolished in 2029 [2025], and every 12th year after that year,
300298 are reviewed.
301299 ARTICLE 6. ENTITIES REMOVED FROM SPECIFIC SUNSET REVIEW
302300 SECTION 6.01. REGIONAL EDUCATION SERVICE CENTERS. The
303301 following laws are repealed:
304302 (1) Section 8.010, Education Code; and
305303 (2) Section 2(b), Chapter 916 (S.B. 1404), Acts of the
306304 85th Legislature, Regular Session, 2017.
307305 SECTION 6.02. STATE PROCUREMENT SYSTEM AND RELATED
308306 COMPTROLLER AUTHORITY. Sections 2151.0041 and 2151.0042,
309307 Government Code, are repealed.
310308 SECTION 6.03. STATE USE PROGRAM, TEXAS COMPTROLLER OF
311309 PUBLIC ACCOUNTS. Section 122.0012(a), Human Resources Code, is

315313 ARTICLE 7. SUNSET REVIEW PROCESS
316314 SECTION 7.01. DEFINITIONS. Section 325.002(1), Government
317315 Code, is amended to read as follows:
318316 (1) "State agency" means an entity [agency] expressly
319317 made subject to this chapter.
320318 SECTION 7.02. SUNSET ADVISORY COMMISSION. Section 325.003,
321319 Government Code, is amended by amending Subsections (a) and (e) and
322320 adding Subsections (a-1) and (e-1) to read as follows:
323321 (a) The Sunset Advisory Commission is a legislative agency
324322 that consists of five members of the senate and one public member
325323 appointed by the lieutenant governor and five members of the house
326324 of representatives and one public member appointed by the speaker
327325 of the house. The lieutenant governor and the speaker of the house
328326 may serve as one of the legislative appointees.
329327 (a-1) A public member acts on behalf of the legislature when
330328 participating on the commission in furtherance of the legislature's
331329 duty to provide oversight of executive branch agencies'
332330 implementation of legislative priorities.
333331 (e) Members other than the lieutenant governor and the
334332 speaker are subject to the following restrictions:
335333 (1) after a legislative member [an individual] serves
336334 two terms [six years] on the commission or a public member serves
337335 three terms on the commission, the individual is not eligible for
338336 appointment to another term or part of a term;
339337 (2) a legislative member who serves a full term may not
340338 be appointed to an immediately succeeding term; and
341339 (3) a public member may not serve more than two
342340 consecutive terms, and, for purposes of this prohibition, a member
343341 is considered to have served a term only if the member has served
344342 more than half of the term.
345343 (e-1) If an individual serves for less than a full term, the
346344 term is not counted toward determining the individual's eligibility
347345 to serve on the commission under Subsection (e)(1) unless the
348346 individual was a member of the commission for each public hearing at
349347 which the state agencies being reviewed during the individual's
350348 term were discussed.
351349 SECTION 7.03. PUBLIC HEARINGS. Section 325.009, Government
352350 Code, is amended by adding Subsection (c) to read as follows:
353351 (c) Notwithstanding Subsection (a), the commission may not
354352 discuss in a public hearing the application to an agency of the
355353 criteria provided in Section 325.011(14). The commission staff
356354 shall notify the commission of any findings and recommendations
357355 regarding the criteria provided in Section 325.011(14).
358356 SECTION 7.04. REPORTS. Section 325.010(b), Government
359357 Code, is amended to read as follows:
360358 (b) In the report the commission shall include:
361359 (1) its findings regarding the criteria prescribed by
362360 Section 325.011, except Section 325.011(14);
363361 (2) its recommendations based on the matters
364362 prescribed by Section 325.012, except recommendations relating to
365363 criteria prescribed by Section 325.011(14); and
366364 (3) other information the commission considers
367365 necessary for a complete review of the agency.
368366 SECTION 7.05. RECOMMENDATIONS. Section 325.0126,
369367 Government Code, is amended to read as follows:
370368 Sec. 325.0126. MONITORING OF RECOMMENDATIONS. During each
371369 legislative session, the staff of the commission shall:
372370 (1) monitor legislation affecting agencies that have
373371 undergone sunset review immediately before the legislative
374372 session;
375373 (2) notify [and shall periodically report to] the
376374 members of the commission about any amendment to the legislation
377375 prepared under Section 325.012(c) that modifies the commission's
378376 [on proposed changes which would modify prior] recommendations for
379377 a state agency; and
380378 (3) provide legislative services to support the
381379 passage of the legislation prepared under Section 325.012(c) [of
382380 the commission].
383381 SECTION 7.06. CONFIDENTIALITY OF INFORMATION. Section
384382 325.019, Government Code, is amended by adding Subsection (d) to
385383 read as follows:
386384 (d) Communications, including conversations,
387385 correspondence, and electronic communications, between the
388386 commission or its staff and a state agency that relate to a request
389387 by the commission for assistance in conducting a review under this
390388 chapter are confidential. A state agency's internal communications
391389 related to a request for assistance by the commission are
392390 confidential, including any information prepared or maintained by
393391 the state agency at the request of the commission or its staff.
394392 With respect to a document, file, or other record prepared or
395393 maintained by the state agency that was created in the normal course

421419 ARTICLE 8. TRANSITION AND EFFECTIVE DATE
422420 SECTION 8.01. TRANSITION. To the extent of any conflict,
423421 this Act prevails over another Act of the 86th Legislature, Regular
424422 Session, 2019, relating to nonsubstantive additions to and
425423 corrections in enacted codes.
426424 SECTION 8.02. EFFECTIVE DATE. This Act takes effect
427425 immediately if it receives a vote of two-thirds of all the members
428426 elected to each house, as provided by Section 39, Article III, Texas
429427 Constitution. If this Act does not receive the vote necessary for
430428 immediate effect, this Act takes effect September 1, 2019.
