5	9		relating to the sunset review process and certain governmental
6	10		entities subject to that process.
7	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	12		ARTICLE 1. ENTITIES GIVEN 2021 SUNSET DATE
9	13		SECTION 1.01. TEACHER RETIREMENT SYSTEM OF TEXAS. Section
10	14		825.006, Government Code, is amended to read as follows:
11	15		Sec. 825.006. SUNSET PROVISION. The board of trustees of
12	16		the Teacher Retirement System of Texas is subject to review under
13	17		Chapter 325 (Texas Sunset Act), but is not abolished under that
14	18		chapter. The board shall be reviewed during the period in which
15	19		state agencies abolished in 2021 [2025], and every 12th year after
16	20		that year, are reviewed.
17	21		SECTION 1.02. ANATOMICAL BOARD OF THE STATE OF TEXAS.
18	22		Subchapter A, Chapter 691, Health and Safety Code, is amended by
19	23		adding Section 691.003 to read as follows:
20	24		Sec. 691.003. SUNSET PROVISION. The Anatomical Board of
21	25		the State of Texas is subject to Chapter 325, Government Code (Texas
22	26		Sunset Act). Unless continued in existence as provided by that
23	27		chapter, the board is abolished September 1, 2021.
24	28		SECTION 1.03. TEXAS DEPARTMENT OF LICENSING AND REGULATION.
25	29		Section 51.002, Occupations Code, is amended to read as follows:
26	30		Sec. 51.002. APPLICATION OF SUNSET ACT. (a) The Texas
27	31		Commission of Licensing and Regulation and the Texas Department of
28	32		Licensing and Regulation are subject to Chapter 325, Government
29	33		Code (Texas Sunset Act). Unless continued in existence as provided
30	34		by that chapter, the commission and the department are abolished
31	35		September 1, 2021.
32	36		(b) The review of the commission and department by the
33	37		Sunset Advisory Commission under this section may not include a
34	38		review of any program that was transferred to the department on or
35	39		after September 1, 2016.
36	40		SECTION 1.04. TEXAS RACING COMMISSION. Section
37	41		2021.008(a), Occupations Code, is amended to read as follows:
38	42		(a) The commission is subject to Chapter 325, Government
39	43		Code (Texas Sunset Act). Unless continued in existence as provided
40	44		by that chapter, and except as provided by Subsections (b) and (c),
41	45		the commission is abolished and this subtitle expires September 1,
42	46		2021 [2023].
43	47		ARTICLE 2. ENTITIES GIVEN 2023 SUNSET DATE
44	48		SECTION 2.01. LIMITED REVIEW OF DEPARTMENT OF FAMILY AND
45	49		PROTECTIVE SERVICES. Section 531.0206(a), Government Code, is
46	50		amended to read as follows:
47	51		(a) The Sunset Advisory Commission shall conduct a
48	52		limited-scope review of the commission during the state fiscal
49	53		biennium ending August 31, 2023, in the manner provided by Chapter
50	54		325 (Texas Sunset Act). The review must provide:
51	55		(1) an update on the commission's progress with
52	56		respect to the consolidation of the health and human services
53	57		system mandated by this subchapter, including the commission's
54	58		compliance with the transition plan required under Section
55	59		531.0204;
56	60		(2) an evaluation and recommendations regarding the
57	61		need to continue the Department of State Health Services as a state
58	62		agency separate from the commission;
59	63		(3) an evaluation and recommendations regarding the
60	64		need to continue the Department of Family and Protective Services
61	65		as a state agency separate from the commission; and
62	66		(4) [(3)] any additional information the Sunset
63	67		Advisory Commission determines appropriate, including information
64	68		regarding any additional organizational changes the Sunset
65	69		Advisory Commission recommends.
66	70		SECTION 2.02. OFFICE OF INSPECTOR GENERAL, HEALTH AND HUMAN
67	71		SERVICES COMMISSION. (a) Section 531.102, Government Code, is
68	72		amended by adding Subsection (y) to read as follows:
69	73		(y) The Sunset Advisory Commission shall conduct a
70	74		special-purpose review of the overall performance of the
71	75		commission's office of inspector general. In conducting the
72	76		review, the Sunset Advisory Commission shall particularly focus on
73	77		the office's investigations and the effectiveness and efficiency of
74	78		the office's processes. The review shall be conducted during the
75	79		period in which state agencies abolished in 2023 are reviewed. The
76	80		office is not abolished solely because the office is not explicitly
77	81		continued following the review required by this subsection. This
78	82		subsection expires September 1, 2023.
79	83		(b) Section 14, Chapter 945 (S.B. 207), Acts of the 84th
80	84		Legislature, Regular Session, 2015, is repealed.
81	85		SECTION 2.03. TEXAS INVASIVE SPECIES COORDINATING
82	86		COMMITTEE. Section 776.007(a), Government Code, is amended to read
83	87		as follows:
84	88		(a) The committee is subject to Chapter 325 (Texas Sunset
85	89		Act). Unless continued in existence as provided by that chapter,
86	90		the committee is abolished and this chapter expires September 1,
87	91		2023 [2021].
88	92		SECTION 2.04. TEXAS JUVENILE JUSTICE BOARD AND TEXAS
89	93		JUVENILE JUSTICE DEPARTMENT. Section 202.010, Human Resources
90	94		Code, is amended to read as follows:
91	95		Sec. 202.010. SUNSET PROVISION. The Texas Juvenile Justice
92	96		Board and the Texas Juvenile Justice Department are subject to
93	97		Chapter 325, Government Code (Texas Sunset Act). Unless continued
94	98		in existence as provided by that chapter, the board and the
95	99		department are abolished September 1, 2023 [2021].
96	100		SECTION 2.05. DIVISION OF WORKERS' COMPENSATION, TEXAS
97	101		DEPARTMENT OF INSURANCE. Section 31.004(b), Insurance Code, is
98	102		amended to read as follows:
99	103		(b) Unless continued as provided by Chapter 325, Government
100	104		Code, the duties of the division of workers' compensation of the
101	105		Texas Department of Insurance under Title 5, Labor Code, expire
102	106		September 1, 2023 [2021], or another date designated by the
103	107		legislature.
104	108		SECTION 2.06. OFFICE OF INJURED EMPLOYEE COUNSEL. Section
105	109		404.003, Labor Code, is amended to read as follows:
106	110		Sec. 404.003. SUNSET PROVISION. The office of injured
107	111		employee counsel is subject to Chapter 325, Government Code (Texas
108	112		Sunset Act). Unless continued in existence as provided by that
109	113		chapter, the office is abolished and this chapter expires September
110	114		1, 2023 [2021].
111		-	SECTION 2.07. REVIEW OF PROGRAMS TRANSFERRED TO TEXAS
112		-	DEPARTMENT OF LICENSING AND REGULATION. Subchapter A, Chapter 51,
113		-	Occupations Code, is amended by adding Section 51.0021 to read as
114		-	follows:
115		-	Sec. 51.0021. SUNSET REVIEW OF TRANSFERRED PROGRAMS.
116		-	(a) Separate from the review of the commission and department
117		-	required under Section 51.002, the commission and department are
118		-	subject to a limited review under Chapter 325, Government Code
119		-	(Texas Sunset Act), of the programs transferred to the department
120		-	on or after September 1, 2016. The review shall be conducted during
121		-	the period in which state agencies abolished in 2023 are reviewed.
122		-	(b) This section expires September 1, 2023.

133	125		SECTION 3.01. STATE COMMISSION ON JUDICIAL CONDUCT.
134	126		Section 33.003, Government Code, is amended to read as follows:
135	127		Sec. 33.003. SUNSET PROVISION. The State Commission on
136	128		Judicial Conduct is subject to review under Chapter 325 (Texas
137	129		Sunset Act), but is not abolished under that chapter. The
138	130		commission shall be reviewed during the period in which state
139	131		agencies abolished in 2025, [2023] and every 12th year after that
140	132		year, [2023] are reviewed.
141	133		SECTION 3.02. JUDICIAL BRANCH CERTIFICATION COMMISSION.
142	134		Section 152.001, Government Code, is amended to read as follows:
143	135		Sec. 152.001. SUNSET PROVISION. The Judicial Branch
144	136		Certification Commission is subject to Chapter 325 (Texas Sunset
145	137		Act), but is not abolished under that chapter. The commission shall
146	138		be reviewed during the period in which state agencies abolished in
147	139		2025, [2023] and every 12th year after that year, [2023] are
148	140		reviewed.
149	141		SECTION 3.03. TEXAS BOARD OF CRIMINAL JUSTICE AND TEXAS
150	142		DEPARTMENT OF CRIMINAL JUSTICE. Section 492.012, Government Code,
151	143		is amended to read as follows:
152	144		Sec. 492.012. SUNSET PROVISION. The Texas Board of
153	145		Criminal Justice and the Texas Department of Criminal Justice are
154	146		subject to Chapter 325 (Texas Sunset Act). Unless continued in
155	147		existence as provided by that chapter, the board and the department
156	148		are abolished September 1, 2025 [2021].
157	149		SECTION 3.04. DEPARTMENT OF INFORMATION RESOURCES. Section
158	150		2054.005(a), Government Code, is amended to read as follows:
159	151		(a) The Department of Information Resources is subject to
160	152		Chapter 325 (Texas Sunset Act). Unless continued in existence as
161	153		provided by that chapter, the department is abolished and this
162	154		chapter expires September 1, 2025 [2021].
163	155		SECTION 3.05. ANGELINA AND NECHES RIVER AUTHORITY. Section
164	156		8501.0015(a), Special District Local Laws Code, is amended to read
165	157		as follows:
166	158		(a) The authority is subject to review under Chapter 325,
167	159		Government Code (Texas Sunset Act), but may not be abolished under
168	160		that chapter. The review shall be conducted under Section 325.025,
169	161		Government Code, as if the authority were a state agency scheduled
170	162		to be abolished September 1, 2025 [2023], and every 12th year after
171	163		that year.
172	164		SECTION 3.06. LOWER NECHES VALLEY AUTHORITY. Section

190	182		Sec. 13.002. APPLICATION OF SUNSET ACT. The Office of
191	183		Public Utility Counsel is subject to Chapter 325, Government Code
192	184		(Texas Sunset Act). Unless continued in existence as provided by
193	185		that chapter, the office is abolished and this chapter expires
194	186		September 1, 2025 [2023].
195	187		SECTION 3.09. SABINE RIVER AUTHORITY OF TEXAS. Section
196	188		2A(a), Chapter 110, Acts of the 51st Legislature, Regular Session,
197	189		1949, is amended to read as follows:
198	190		(a) The district is subject to review under Chapter 325,
199	191		Government Code (Texas Sunset Act), but may not be abolished under

213	205		ARTICLE 4. ENTITIES GIVEN 2027 SUNSET DATE
214	206		SECTION 4.01. TEXAS EDUCATION AGENCY. Section 7.004,
215	207		Education Code, is amended to read as follows:
216	208		Sec. 7.004. SUNSET PROVISION. (a) The Texas Education
217	209		Agency is subject to Chapter 325, Government Code (Texas Sunset
218	210		Act). Unless continued in existence as provided by that chapter,
219	211		the agency is abolished September 1, 2027 [2025].
220	212		(b) As part of the Sunset Advisory Commission's review of
221	213		the agency under Subsection (a), the commission in coordination
222	214		with the agency shall select for review three regional education
223	215		service centers that serve diverse geographic areas of the state
224	216		and diverse population sizes. The commission's review of the
225	217		agency must include an evaluation of the agency's oversight of the
226	218		centers.
227	219		SECTION 4.02. EXPANDED LEARNING OPPORTUNITIES COUNCIL.
228	220		Section 33.254, Education Code, is amended to read as follows:
229	221		Sec. 33.254. SUNSET PROVISION. The council is subject to
230	222		Chapter 325, Government Code (Texas Sunset Act). Unless continued
231	223		in existence as provided by that chapter, the council is abolished
232	224		and this subchapter expires September 1, 2027 [2023].

293	291		SECTION 5.01. TEXAS EMERGENCY SERVICES RETIREMENT SYSTEM.
294	292		Section 865.0011, Government Code, is amended to read as follows:
295	293		Sec. 865.0011. SUNSET REVIEW. The state board of the
296	294		pension system is subject to review under Chapter 325 (Texas Sunset
297	295		Act) but is not abolished under that chapter. The state board shall
298	296		be reviewed during the period in which state agencies scheduled to
299	297		be abolished in 2029 [2025], and every 12th year after that year,
300	298		are reviewed.
301	299		ARTICLE 6. ENTITIES REMOVED FROM SPECIFIC SUNSET REVIEW
302	300		SECTION 6.01. REGIONAL EDUCATION SERVICE CENTERS. The
303	301		following laws are repealed:
304	302		(1) Section 8.010, Education Code; and
305	303		(2) Section 2(b), Chapter 916 (S.B. 1404), Acts of the
306	304		85th Legislature, Regular Session, 2017.
307	305		SECTION 6.02. STATE PROCUREMENT SYSTEM AND RELATED
308	306		COMPTROLLER AUTHORITY. Sections 2151.0041 and 2151.0042,
309	307		Government Code, are repealed.
310	308		SECTION 6.03. STATE USE PROGRAM, TEXAS COMPTROLLER OF
311	309		PUBLIC ACCOUNTS. Section 122.0012(a), Human Resources Code, is
312	310		repealed.
313	311		SECTION 6.04. INTERMUNICIPAL COMMUTER RAIL DISTRICTS.
314	312		Section 173.005, Transportation Code, is repealed.
315	313		ARTICLE 7. SUNSET REVIEW PROCESS
316	314		SECTION 7.01. DEFINITIONS. Section 325.002(1), Government
317	315		Code, is amended to read as follows:
318	316		(1) "State agency" means an entity [agency] expressly
319	317		made subject to this chapter.
320	318		SECTION 7.02. SUNSET ADVISORY COMMISSION. Section 325.003,
321	319		Government Code, is amended by amending Subsections (a) and (e) and
322	320		adding Subsections (a-1) and (e-1) to read as follows:
323	321		(a) The Sunset Advisory Commission is a legislative agency
324	322		that consists of five members of the senate and one public member
325	323		appointed by the lieutenant governor and five members of the house
326	324		of representatives and one public member appointed by the speaker
327	325		of the house. The lieutenant governor and the speaker of the house
328	326		may serve as one of the legislative appointees.
329	327		(a-1) A public member acts on behalf of the legislature when
330	328		participating on the commission in furtherance of the legislature's
331	329		duty to provide oversight of executive branch agencies'
332	330		implementation of legislative priorities.
333	331		(e) Members other than the lieutenant governor and the
334	332		speaker are subject to the following restrictions:
335	333		(1) after a legislative member [an individual] serves
336	334		two terms [six years] on the commission or a public member serves
337	335		three terms on the commission, the individual is not eligible for
338	336		appointment to another term or part of a term;
339	337		(2) a legislative member who serves a full term may not
340	338		be appointed to an immediately succeeding term; and
341	339		(3) a public member may not serve more than two
342	340		consecutive terms, and, for purposes of this prohibition, a member
343	341		is considered to have served a term only if the member has served
344	342		more than half of the term.
345	343		(e-1) If an individual serves for less than a full term, the
346	344		term is not counted toward determining the individual's eligibility
347	345		to serve on the commission under Subsection (e)(1) unless the
348	346		individual was a member of the commission for each public hearing at
349	347		which the state agencies being reviewed during the individual's
350	348		term were discussed.
351	349		SECTION 7.03. PUBLIC HEARINGS. Section 325.009, Government
352	350		Code, is amended by adding Subsection (c) to read as follows:
353	351		(c) Notwithstanding Subsection (a), the commission may not
354	352		discuss in a public hearing the application to an agency of the
355	353		criteria provided in Section 325.011(14). The commission staff
356	354		shall notify the commission of any findings and recommendations
357	355		regarding the criteria provided in Section 325.011(14).
358	356		SECTION 7.04. REPORTS. Section 325.010(b), Government
359	357		Code, is amended to read as follows:
360	358		(b) In the report the commission shall include:
361	359		(1) its findings regarding the criteria prescribed by
362	360		Section 325.011, except Section 325.011(14);
363	361		(2) its recommendations based on the matters
364	362		prescribed by Section 325.012, except recommendations relating to
365	363		criteria prescribed by Section 325.011(14); and
366	364		(3) other information the commission considers
367	365		necessary for a complete review of the agency.
368	366		SECTION 7.05. RECOMMENDATIONS. Section 325.0126,
369	367		Government Code, is amended to read as follows:
370	368		Sec. 325.0126. MONITORING OF RECOMMENDATIONS. During each
371	369		legislative session, the staff of the commission shall:
372	370		(1) monitor legislation affecting agencies that have
373	371		undergone sunset review immediately before the legislative
374	372		session;
375	373		(2) notify [and shall periodically report to] the
376	374		members of the commission about any amendment to the legislation
377	375		prepared under Section 325.012(c) that modifies the commission's
378	376		[on proposed changes which would modify prior] recommendations for
379	377		a state agency; and
380	378		(3) provide legislative services to support the
381	379		passage of the legislation prepared under Section 325.012(c) [of
382	380		the commission].
383	381		SECTION 7.06. CONFIDENTIALITY OF INFORMATION. Section
384	382		325.019, Government Code, is amended by adding Subsection (d) to
385	383		read as follows:
386	384		(d) Communications, including conversations,
387	385		correspondence, and electronic communications, between the
388	386		commission or its staff and a state agency that relate to a request
389	387		by the commission for assistance in conducting a review under this
390	388		chapter are confidential. A state agency's internal communications
391	389		related to a request for assistance by the commission are
392	390		confidential, including any information prepared or maintained by
393	391		the state agency at the request of the commission or its staff.
394	392		With respect to a document, file, or other record prepared or
395	393		maintained by the state agency that was created in the normal course
396	394		of the agency's business and not at the request of the commission,
397	395		the confidentiality created by this subsection applies only to
398	396		information in the possession of the commission.
399	397		SECTION 7.07. RIVER AUTHORITIES. Section 325.025(b),
400	398		Government Code, as amended by Chapters 975 (S.B. 2262) and 1046
401	399		(H.B. 1920), Acts of the 85th Legislature, Regular Session, 2017,
402	400		is reenacted to read as follows:
403	401		(b) This section applies to the:
404	402		(1) Angelina and Neches River Authority;
405	403		(2) Bandera County River Authority and Groundwater
406	404		District;
407	405		(3) Brazos River Authority;
408	406		(4) Guadalupe-Blanco River Authority;
409	407		(5) Lavaca-Navidad River Authority;
410	408		(6) Lower Colorado River Authority;
411	409		(7) Lower Neches Valley Authority;
412	410		(8) Nueces River Authority;
413	411		(9) Red River Authority of Texas;
414	412		(10) Sabine River Authority of Texas;
415	413		(11) San Antonio River Authority;
416	414		(12) San Jacinto River Authority;
417	415		(13) Sulphur River Basin Authority;
418	416		(14) Trinity River Authority of Texas;
419	417		(15) Upper Colorado River Authority; and
420	418		(16) Upper Guadalupe River Authority.
421	419		ARTICLE 8. TRANSITION AND EFFECTIVE DATE
422	420		SECTION 8.01. TRANSITION. To the extent of any conflict,
423	421		this Act prevails over another Act of the 86th Legislature, Regular
424	422		Session, 2019, relating to nonsubstantive additions to and
425	423		corrections in enacted codes.
426	424		SECTION 8.02. EFFECTIVE DATE. This Act takes effect
427	425		immediately if it receives a vote of two-thirds of all the members
428	426		elected to each house, as provided by Section 39, Article III, Texas
429	427		Constitution. If this Act does not receive the vote necessary for
430	428		immediate effect, this Act takes effect September 1, 2019.
