5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to peace officer training on recognizing and recording
68 circumstances that indicate strangulation in certain cases.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 1701.253(d), Occupations Code, is
911 amended to read as follows:
1012 (d) Training in documentation of cases required by
1113 Subsection (b) shall include instruction in:
1214 (1) making a written account of the extent of injuries
1315 sustained by the victim of an alleged offense;
1416 (2) recording by photograph or videotape the area in
1517 which an alleged offense occurred and the victim's injuries; [and]
1618 (3) recognizing and recording a victim's statement
1719 that may be admissible as evidence in a proceeding concerning the
1820 matter about which the statement was made; and
1921 (4) recognizing and recording circumstances
2022 indicating that a victim may have been assaulted in the manner
2123 described by Section 22.01(b)(2)(B), Penal Code.
2224 SECTION 2. Section 1701.352(f), Occupations Code, is
2325 amended to read as follows:
2426 (f) Training in documentation of cases required by
2527 Subsection (b) shall include instruction in:
2628 (1) making a written account of the extent of injuries
2729 sustained by the victim of an alleged offense;
2830 (2) recording by photograph or videotape the area in
2931 which an alleged offense occurred and the victim's injuries; [and]
3032 (3) recognizing and recording a victim's statement
3133 that may be admissible as evidence in a proceeding concerning the
3234 matter about which the statement was made; and
3335 (4) recognizing and recording circumstances
3436 indicating that a victim may have been assaulted in the manner
3537 described by Section 22.01(b)(2)(B), Penal Code.
3638 SECTION 3. (a) Not later than January 1, 2020, the Texas
3739 Commission on Law Enforcement shall establish or modify training
3840 programs as necessary to comply with Section 1701.253, Occupations
3941 Code, as amended by this Act.
4042 (b) The minimum curriculum requirements under Section
4143 1701.253(d), Occupations Code, as amended by this Act, apply only
4244 to a peace officer who first begins to satisfy those requirements on
4345 or after January 1, 2020.
4446 SECTION 4. This Act takes effect September 1, 2019.
